Transaksi jual beli melalui internet memudahkan konsumen untuk bertransaksi, dari segi waktu lebih efisien, namun dalam pelaksanaannya transaksi tersebut memiliki kekurangan seperti konsumen tidak dapat langsung melihat kualitas produk, barang yang dibeli tidak sampai serta adanya bahaya penipuan dari produsen atau penjual fiktif yang merugikan konsumen. Tujuan penelitian ini diharapkan dapat memberikan kontribusi berupa analisis yang bersifat holistik dan integral dalam bidang transaksi jual beli melalui internet, khususnya perlindungan hak-hak konsumen serta tanggung jawab pelaku usaha. Kontribusi yang diharapkan dapat memberikan wawasan serta menanamkan cara berpikir yang kritis dalam mempelajari dan memahami transaksi jual beli melalui internet berdasarkan peraturan yang ada. Bagi para mahasiswa, penelitian ini diharapkan dapat memberikan gambaran utuh perihal praktik transaksi jual beli melalui internet. Selain itu, penelitian ini diharapkan dapat memberikan masukan dalam pembentukan peraturan pelaksana / peraturan pemerintah yang baru sebagai tindak lanjut dari UU Informasi dan Transaksi Elektronik (UU ITE) dan PP Penyelenggaraan Sistem dan Transaksi Elektronik (PP PSTE). Penelitian ini adalah penelitian hukum kombinasi dimana gabungan dari penelitian hukum normatif dan penelitian hukum empiris, penelitian hukum normatif yaitu penelitian untuk mengetahui atau mengenal apakah dan bagaimanakah hukum positifnya mengenai suatu hal, peristiwa, atau masalah tertentu. Penelitian ini berfokus pada upaya pemenuhan hak-hak konsumen dalam transaksi jual beli barang melalui internet dan pelaksanaan tanggung jawab penjual terhadap kerugian dalam hal hak-hak konsumen tidak terpenuhi. Data yang diperoleh berdasarkan data primer yang diperoleh Penulis secara langsung memperoleh informasi dari respoden dan melakukan wawancara dengan konsumen serta divisi terkait cybercrime Polda Metro Jaya serta analisis pustaka yang diperoleh dari KUHPerdata, UU PK, UU ITE dan PP PSTE. Hasil penelitian memperlihatkan bahwa pemenuhan hak-hak konsumen dalam transaksi jual beli barang melalui internet belum terpenuhi secara keseluruhan, dalam hal terjadi kondisi dimana pelaku usaha tidak melaksanakan kewajibannya dalam melaksanakan pengiriman barang ataupun mengirimkan barang tidak sesuai dengan yang diperjanjikan, Pemerintah dalam hal ini masih memberikan sanksi kepada pelaku usaha berupa hukuman pidana, namun untuk memenuhi hak konsumen itu sendiri belum dapat terealisasi dengan baik. Saran dari Penulis bagi konsumen agar lebih berhati-hati dalam melakukan transaksi jual beli melalui internet, bagi pelaku usaha agar tidak melakukan tindakan wanprestasi guna memperoleh keuntungan yang berlebih, bagi Pemerintah agar dapat membuat suatu ketentuan yang secara khusus mengatur mengenai perlindungan hak-hak konsumen dalam transaksi jual beli melalui internet.

Commercial transactions through internet make the easy thing for consumer in making the transactions, so that from the time sector it more efficient but in its implementation, such transaction also have a declining such the consumer cannot look directly the quality of product, the product which is bough cannot be received by the consumer or there is a deception dangerous from producer or the fictive seller who make the consumer loss. The purpose of this research is in order to make a target which can make the contribution like analysis that have holistic characteristic and integral thing in the commercial transaction sector through internet, specially talking about the protection to fulfilling of consumer’s rights and also the responsibility of the business doer. The hoped contribution in order that can give the knowledge and make the way of thinking that critical in learning and understanding the commercial transaction through internet base on the rule which is valid. For the university students this research be hoped can give the complete illustration about the practice of commercial transaction through internet. Besides that, also can give the advice informing the regulation in implementing / the regulation of government which is new as the following action from The Laws of information and transaction of electronics and regulation of Government of implementation of system and transaction of electronics. This research is law research and also combination whereas the combination of normative law research and empirical law research whereas the normative law research namely the research for knowing or introduce what about and how about its positive law of something, the moment or event, or the decided problem. This research have a focus to the effort in fulfilling the rights of consumer in commercial transaction for goods through internet and the implementation of responsibility of the seller to the loss in the matter of consumer’s rights is not fulfilled in goods commercial transactions through internet. Data that be gotten is based on primary data whereas the writer get the information directly from the respondent and doing the interview with consumer and related division cybercrime, Polda Metro Jaya and library analysis that be gotten from KUHPerdata, UU PK, UU ITE and PP PSTE. Result of research give something whereas the implementation in fulfilling the consumer’s rights in goods commercial transaction through internet is not fulfilling completely, in the matter about the occurrence of the condition whereas the business doer do not implement its obligation in doing the delivery of goods or to deliver the goods do not suitable to the agreement. In the matter, government still give the sanction to the business doer like crime law but in the matter for fulfilling the consumer’s right it self do not realized well. The suggestion from the writer for the consumer in order can more prudent in doing the commercial transaction through internet, for the business doer in order do not make the crime thing in order to get the high profit, for the government in order that can make something about regulation that special to arrange about the protection of consumer to the fulfilling the consumer’s right in commercial transaction through internet.
