Protokol Madrid: Mengakomodasi Fitur dari Madrid Protokol Dalam Skema Pendaftaran Merek Internasional Dalam Rancangan Terbaru Undang-Undang Merek Indonesia Oleh: Ahmad Nabriz, Dina Widyaputri Kariodimedjo INTISARI Penelitian ini ditujukan untuk membentuk sebuah pemahaman yang lebih baik mengenai fitur mendasar dari skema pendaftaran internasional yang memungkinkan tercapainya perlindungan yang lebih ekstensif melalui satu proses pendaftaran. Selain itu, penelitian ini juga ditujukan untuk mencari informasi lebih lanjut mengenai fitur utama yang harus terakomodir didalam Rancangan Undang-Undang (RUU) Merek Indonesia. Kemudian, penelitian ini juga difokuskan pada topik mengenai cara dari anggota Madrid Union dalam mengakomodir Madrid Protokol dalam Hukum Merek. Metode penelitian yang digunakan dalam penelitian ini berbasis pada karakteristik komparatif-yuridis empiris. Metode tersebut mengedepankan tidak hanya kombinasi penelitian hukum dan lapangan, namun juga menambahkan studi komparatif untuk menemukan platform legislasi yang diimplementasikan oleh sampel negara anggota Madrid Union yaitu Jepang, Australia dan Singapura. Data yang didapat kemudian diolah menggunakan analisis kualitatifdeskriptif. Penelitian ini telah mengarah kepada beberapa temuan yang informatif. Penulis menemukan bahwa fitur mendasar dari skema pendaftaran internasional tidak hanya berlandaskan pada landasan hukum yang dicantumkan pada Pasal 3bis dan 3ter, namun juga berlandaskan pada aspek teknis seperti struktur Madrid Union itu sendiri (Sidang Umum, Biro Internasional, dan Direktur General) dan roadmap aksesi Protokol Madrid yang disediakan World Intellectual Property Organization (WIPO). Ditemukan pula bahwa terdapat beberapa miskonsepsi dan tema yang tidak tercakup dalam Naskah Akademik RUU Merek. Terakhir, penelitian ini juga menemukan dua jenis platform legislasi. Jenis pertama seperti yang dilakukan Jepang yaitu membentuk satu Bab khusus yang mengatur secara keseluruhan tentang skema pendaftaran internasional. Pilihan lainnya seperti yang dilakukan Australia dan Singapura, yaitu menyusun secara terpisah pasal-pasal mengenai pendaftaran merek lalu kemudian menambahkan satu Bab khusus yang hanya menerangkan bahwa Undang-Undang tersebut telah mengakomodir pendaftaran internasional merek yang disediakan oleh Protokol. Madrid Protocol: Accomodating Madrid Protocol's Features On International Marks Registration Scheme To The Proposed Bill Of The New Indonesian Trademark Law By: Ahmad Nabriz; Dina Widyaputri Karidimedjo ABSTRACT The legal research is aimed to establish a better understanding on the elemental features of International Registration Scheme that enables extensive protection through a single registration process. It is also aimed to find further information regarding the key features that have to be accommodated in the proposed amendment of Indonesian Trademark Act. In addition, it is also focused on the issue on how the members of Madrid Union implement the obligations deriving from the accession of the Madrid Protocol into the Trade Marks Act. Research method that is used within the legal research at hand is based on the Comparative-Juridical Empiric characteristic. It emphasize not only on the perspective of law combined with the factual information obtained in the field, but also involves comparative study upon the possible platform of legislation that is implemented in the sample countries of Madrid Union namely Japan, Australia and Singapore. The data obtained then analyzed using qualitative-descriptive analysis. The legal research had led to several informative findings. The writer found that the elemental features of the International Registration Scheme were not only based on the legal foundation mentioned in the Article 3bis and 3ter, but also the technical aspects such as the structure of Madrid Union (the Assembly, International Bureau, and the Director General) and the roadmap of Madrid Protocol accession provided by the World Intellectual Property Organization (WIPO). It is also found that there are several misconception and undisclosed issues that need to be revised within the Academic Analysis Document on the Proposed Bill of Indonesian Trademark Law. Lastly, the research resulted two interesting platform of legislation. The first platform as performed by Japan, is to establish a whole Chapter within the Trademark Law, which discuss the issue of International Marks Registration scheme. Another option that was found as performed both by Australia and Singapore, is the establishment of separated Articles regulating aspects of Trademark registration issues and then add a whole new Chapter emphasizing only the information that the law presented had accommodated International Marks Registration provided by the Protocol.
