PENGARUH PENERAPAN ASEAN COMMUNITY 2015 TERHADAP MEKANISME PENYELESAIAN SENGKETA ASEAN

Perwujudan ASEAN Community 2015 memerlukan persiapan yang matang terutama dalam menghadapi tantangan-tantangan global yang akan muncul. Penelitian ini bertujuan untuk mengetahui, memahami, menggambarkan dan menganalisis pengaruh penerapan ASEAN Community 2015 terhadap mekanisme penyelesaian sengketa ASEAN. Hal ini sebagai upaya untuk menjamin terlaksananya ASEAN Community 2015 berdasarkan ketiga pilarnya. Penelitian ini dilakukan secara normatif dan empiris yang mengedepankan studi pustaka dengan basis data sekunder, yaitu: bahan hukum primer dan sekunder. Kemudian didukung oleh data primer yang berbasis data dari lapangan, dalam hal ini wawancara langsung dengan narasumber yang berkompetensi mengenai permasalahan dalam penelitian ini. Dalam penelitian ini digunakan juga beberapa pendekatan, yaitu pendekatan undang-undang, konsep, historis dan kasus. Data yang diperoleh kemudian diolah secara kualitatif. Hasil penelitian menunjukkan bahwa penerapan ASEAN Community 2015 akan meningkatkan potensi konflik di kawasan ASEAN. Akan tetapi masih kurangnya kepercayaan dari negara-negara anggota ASEAN untuk menggunakan mekanisme penyelesaian yang telah dibentuk oleh ASEAN membuat mekanisme penyelesaian sengketa ASEAN menjadi lemah. Sehingga dalam beberapa kasus, negara-negara anggota ASEAN lebih mempercayakan penyelesaian sengketa melalui lembaga penyelesaian sengketa di luar ASEAN, meskipun dalam kenyataannya masih banyak kasus yang sampai sekarang belum dapat diselesaikan oleh ASEAN. Oleh kerena itu, ASEAN perlu melakukan perbaikan terhadap mekanisme penyelesaian sengketanya agar pelaksanaan ASEAN Community 2015 dapat berjalan seperti yang telah dicita-citakan.

Embodiment of the ASEAN Community 2015 requires well-preparation, especially to face the global challenges, which will arise due to the embodiment of the ASEAN Community 2015. This study aims to determine, to understand, to describe and to analyze the effect of the application of the ASEAN Community 2015 towards the ASEAN dispute settlement mechanism. It is an effort to ensure the implementation of the ASEAN Community 2015 by the three pillars. This study is conducted in normative and empirical literature study, which prioritizes the secondary data, namely: primary legal materials and secondary legal materials. Furthermore, the secondary data is supported by the data based on primary data from the field, by using a competent source interviews in relation to the problems in this research. In this study, it also uses some approaches, namely: legislative approach, concept approach, historical approach and case approach. The data obtained from this research are processed qualitatively. The results shows that the application of the ASEAN Community 2015 will increase the probability of conflict in the ASEAN region. However, the lack of trust from the ASEAN member states to use the dispute settlement mechanism which has been established by the ASEAN makes the ASEAN dispute settlement mechanism become weak. So in some cases, the ASEAN member states preferred to trust their dispute settlement through the dispute resolutions outside of the ASEAN dispute settlement system, although in reality, there are some cases which have not been resolved yet by the ASEAN until now. Therefore, the ASEAN needs to make improvements to the dispute settlement mechanism for the application of the ASEAN Community 2015 to make it work as it has been purposed.
