MANFAAT AKTA KOPERASI YANG DIBUAT OLEH NOTARIS UNTUK MENJAMIN KEPASTIAN HUKUM BAGI ANGGOTANYA DI KABUPATEN BUNGO

Tujuan dari penelitian ini adalah untuk mengetahui dan mengkaji kedudukan akta koperasi yang dibuat oleh notaris terhadap legalitas koperasi di Kabupaten Bungo; manfaat akta koperasi yang dibuat oleh notaris untuk menjamin kepastian hukum bagi anggotanya di Kabupaten Bungo; serta tanggung jawab notaris terhadap akta koperasi yang telah dibuatnya. Penelitian mengenai manfaat Akta Koperasi yang dibuat oleh notaris untuk menjamin kepastian hukum bagi anggotanya di Kabupaten Bungo ini merupakan penelitian normatif empiris. Analisis data yang dipergunakan dalam penelitian ini adalah deskriptif kualitatif, yaitu data yang diperoleh dari penelitian disajikan secara deskriptif dan dianalisis secara kualitatif. Hasil penelitian ini adalah: (1) Peranan Notaris dalam proses Pendirian Koperasi sebagai badan hukum adalah sebagai Pejabat Pembuat Akta Koperasi. Sedangkan kedudukan akta koperasi yang dibuat oleh notaris terhadap legalitas koperasi di Kabupaten Bungo adalah sah menurut hukum sesuai dengan Undang- Undang Nomor 25 Tahun 1992 tentang Perkoperasian. akta koperasi merupakan akta otentik yang dibuat oleh pejabat sehingga memberikan jaminan kepastian hukum bagi koperasi sebagai badan hukum; (2) Manfaat akta koperasi yang dibuat oleh Notaris untuk menjamin kepastian hukum bagi anggotanya di Kabupaten Bungo yaitu dengan dibuatnya akta koperasi oleh Notaris maka kepastian hukum akan diperoleh oleh Koperasi tersebut dan Koperasi dianggap sebagai badan hukum. Dengan mendapatkan status badan hukum, maka sebuah badan usaha koperasi menjadi subjek hukum yang memiliki hak dan kewajiban; serta (3) Tanggung jawab notaris terhadap akta koperasi yang telah dibuatnya adalah Notaris bertanggung jawab atas Akta Koperasi yang dibuatnya sesuai dengan Undang-Undang Nomor 25 Tahun 1992 tentang Perkoperasian. Akta koperasi yang dibuat oleh notaris sangat penting karena untuk memberikan kepastian hukum bagi koperasi guna melaksanakan kegiatannya sesuai AD-ART-nya. Sedangkan peranan Dinas Perindustrian, Perdagangan dan Koperasi dalam memproleh status badan hukum dari Koperasi Yaitu sebagai Pengesahan Badan Hukum yang telah dibuat aktanya oleh Notaris. The purpose of this study was to determine and assess the position of the cooperative deed made by the notary to the legality of cooperatives in Bungo; benefits of cooperative deed made by the notary to ensure legal certainty for its members in Bungo; and the responsibility of the notary deed cooperative that has been made. Research on the benefits of the Cooperative Act made by the notary to ensure legal certainty for its members in Bungo is a normative empirical research. Analysis of data used in this research is descriptive qualitative, ie data obtained from the study are presented descriptively and analyzed qualitatively. The results of this study are: (1) The role of the Notary in the process of establishment of cooperatives as legal entities are as Acting Cooperation Deed.
