PERLINDUNGAN HUKUM BAGI DOKTER TERHADAP PELAKSANAAN INFORMEDCONSENT DALAM PERJANJIAN TERAPEUTIK (STUDI KASUS PUTUSANPENINJAUAN KEMBALI MAHKAMAH AGUNG NOMOR: 79 PK/PID/2013 )

Tujuan dari penelitian ini ialah untuk mengetahui dan memaparkan kedudukan hukum dokter dalam informed consent sebagaimana kewajiban dokter terhadap pasien yang diatur pada Pasal 45 Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, dan mengetahui serta memaparkan perlindungan hukum terhadap dokter terkait pelaksanaan informed consent dalam perjanjian terapeutik Penelitian ini merupakan penelitian hukum normatif. Cara pengumpulan data yang dilakukan dalam penelitian ini dengan metode dokumentasi, yaitu mencari data mengenai hal-hal atau variabel berupa buku-buku, literatur, jurnal, makalah dan peraturan perundang-undangan yang kemudian dikelompokkan sesuai dengan kriteria hukum yang penulis butuhkan. Sedangkan alat pengumpulan data yang digunakan dalam penelitian ini adalah dengan studi dokumen, yakni mengkaji bahan-bahan dari data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Transaksi terapeutik yang lahir karena kesepakatan, kedudukan dokter dan pasien dalam pelaksanaan informed consent ialah sejajar. Terhadap transaksi terapeutik yang lahir karena undang-undang, kedudukan dokter dan pasien dalam informed consent tidak sederajat. Dokter diwajibkan untuk melakukan pertolongan darurat terhadap pasien darurat tanpa harus memperoleh persetujuan terlebih dahulu. Salah satu tujuan dari adanya informed consent ialah memberikan perlindungan hukum bagi dokter dari adanya tuntutan hukum, baik itu penganiayaan ataupun risiko medis yang tak mungkin dihindarkan. Putusan Peninjauan Kembali Mahkamah Agung Nomor 79 PK/PID/2013 melalui pertimbangan hukumnya telah memberikan perlindungan hukum bagi para dokter, yaitu dr. Dewa Ayu Sasiary Prawani, dr. Hendry Simanjuntak dan dr. Hendy Siagian dalam pelaksanaan informed consent dan tuduhan malpraktik dari pihak keluarga pasien Siska Makatey. This research aimed to find out and elaborate the legal standing of doctor within informed consent as in the matter of doctor’s obligations toward patient in accordance to the article 45 Law Number 29 of 2004 concerning Medical Practices, as well as to find out and elaborate the legal protection on doctor toward the implementation of informed consent within therapeutic agreement. This research was a normative legal research. Data were collected through documentation method, found out data related to the matters or variables represented by books, literacies, journals, articles, and legislations, which then further been compiled within each legal criteria as in the need of the researcher. Tools used within this research were through the documental studies, analyzing sources from the secondary data, were primary legal sources, secondary legal sources, and tertiary legal sources. The natural therapeutic transaction due to the agreement, the standing of doctor and patient within the implementation of informed consent is equal. Whilst the natural therapeutic transaction due to the law, the standing of doctor and patient within informed consent is not equal. Doctor was obliged to perform emergency assistance to the patient without acquiring agreement in prior. One of the goals for the existence of informed consent is about to provide legal protection for the doctor against the legal indictment, either on mistreatment or unavoidable medical risk. The decision of Supreme Court Case Review Number 79 PK/PID/2013 through its legal consideration has provided legal protection for the doctors, which were dr. Dewa Ayu Sasiary Prawani, dr. Hendry Simanjuntak and dr. Hendy Siagian within the implementation of informed consent and malpractices accusation from the patient Siska Makatey’s family.
