PERANAN NOTARIS DALAM PELAKSANAAN PEMBAGIAN WARISAN DAN SENGKETA PEWARISAN ADAT LAMPUNG PEPADUN

Permasalahan dalam penelitian ini adalah : (1) Bagaimanakah pelaksanaan pembagian warisan dalam sistem mayorat pada masyarakat Lampung Pepadun?; (2). Bagaimanakah peranan Notaris dalam pembagian dan sengketa waris adat Lampung Pepadun? Tujuan penelitian ini adalah : (1) Untuk mengetahui peranan Notaris dalam pembagian pewarisan adat Lampung Pepadun; (2) Untuk mengetahui pelaksanaan pembagian warisan dalam pewarisan dengan sistem mayorat pada masyarakat Lampung Pepadun. Penelitian ini bersifat yuridis empiris dengan pendekatan kualitatif Jenis datanya adalah data sekunder dan data primer. Alat untuk memperoleh data primer, adalah wawancara. Data yang diperoleh dari hasil penelitian ini diolah dan dianalisis dengan metode analisis kualitatif tanpa melihat frekuensi, akan tetapi menghubungkan satu peristiwa dengan peristiwa yang lain secara sistematis. Kemudian diinterpretasikan dengan ketentuan-ketentuan hukum atau perilaku hukum yang secara nyata dilaksanakan oleh para pihak yang terkait. Kesimpulan penelitian ini adalah : (1) Punyimbang adalah orang yang dominan berperan dalam pelaksanaan pewarisan di masyarakat Adat Lampung Pepadun karena ia mewarisi seluruh harta baik fisik maupun sosial, sedangkan wanita tidak mewaris dan hanya menerima hibah atau wasiat yang dibuat pada saat pewaris masih hidup; (2) Peranan Notaris dalam pelaksanaan pewarisan terbatas pada membantu membuatkan akta hibah dan hibah wasiat, mendaftarkan hibah dan hibah wasiat yang sebelumnya dibuat dibawah tangan serta membuat akta yang lahir dari sengketa kewarisan. Saran penelitian ini adalah : Agar Notaris meningkatkan keterampilan dan pengetahuannya akan hukum waris adat, agar pemerintah lebih menyosialisasikan hokum dan perundang-undangan dan agar masyarakat adat lebih tertarik menggunakan bantuan notaries dalam pelaksanaan pembagian warisan serta dalam penyelesaian sengketa waris, namun untuk menjamin kepastian hukum khususnya yang berkaitan dengan peralihan hak atas tanah., Kata kunci : peranan notaris, hukum waris, waris adat, lampung Pepadun

The problems of the study are: (1) How is the role of Notary in the inheritance distribution Lampung Pepadun customs? (2) How is the implementation of the inheritance distribution with mayorat system to the indigenous of Lampung Pepadun? The purposes of this study are: (1) To determine the notary role in the inheritance distribution of Lampung Pepadun customs, (2) To know the implementation of the inheritance distribution in mayorat system with the indigenous of Lampung Pepadun This study is juridical empirical research with a qualitative approach. The type of data is primary and secondary data. The primary data is obtained from an interview. The data obtained from the results of this study are processed and analyzed with the method of qualitative analysis without looking at the frequency; however, it connects one event to another event systematically. Then it is interpreted with the provisions of the law or the law behavior that actually executed by the parties concerned The conclusion of this research are: (1) The notary role is limited in helping to make the deed of grants and the grant testament as far as there is donating or granting and to register the grants and grant testament previously made behind the scenes. Outside it, Punyimbang is the one who dominantly plays his role in the implementation of inheritance, (2) In solving disputes, notary only plays role to provide advice/s about what to do with inherited property rather than determining distribution of inheritance. (3) The factors that involve Notaries in the inheritance with the mayorat system to the indigenous of Lampung Pepadun are to provide legal certainty for the heirs in order to avoid the disputes that may arise in the future., and to ensure the security of grant certificate in order not to be lost and damaged, that is by storing the grant certificate in the notary off. The suggestion of this research is: although the custom of Lampung Pepadun indigenous does not require involving Notaries to implement inheritance and solving the inheritance dispute, to ensure legal certainty, especially related to transferring rights of land, the local government needs to takes an active role to promote the importance of notaries among indigenous of Lampung.
