PENYELESAIAN WANPRESTASI YANG TERJADI PADA PROSES JUAL BELI PERUMAHAN MENGGUNAKAN SISTEM KREDIT PEMILIKAN RUMAH (KPR) di CV. RAJAWALI PROPERTY

Salah satu unsur pokok dalam kesejahteraan rakyat, adalah terpenuhinya kebutuhan masyarakat dalam bidang papan atau perumahan. Dewasa ini banyak pihak mengambil kesempatan untuk membuka peluang usaha menjadi jasa pengembang atau developer. Kredit Pemilikan Rumah yang ditawarkan pihak perusahaan pengembang dengan didukung pendanaannya oleh pihak bank, merupakan salah satu solusi bagi calon konsumen perumahan untuk dapat segera memiliki perumahan. Praktik Kerja Lapangan merupakan kegiatan wajib yang harus dilaksanakan oleh setiap mahasiswa Program Diploma 3 Universitas Gadjah Mada sebagai syarat untuk meraih gelar Ahli Madya Hukum atau Paralegal. Oleh karena itu, Penulis mengambil Tempat Kerja Lapangandi Kantor Perumahan CV. Rajawali Property, yang merupakan perusahan yang bergerak di bidang properti. Hasil Praktik Kerja Lapangan menunjukan bahwa proses pemilikan rumah dengan sistem Kredit Pemilikan Rumah (KPR) memunculkan berbagai persoalan yang perlu mendapatkan solusi penyelesaiannya. Salah satunya adalah wanprestasi karena melakukan sesuatu yang oleh perjanjian tidak boleh dilakukan, yaitu konsumen tidak menaati peraturan yang tercantum pada Perjanjian Perikatan Jual Beli sehingga konsumen tidak dapat mengajukan Kredit Pemilikan Rumah, dan pihak perusahaan developer sudah melakukan pembangunan perumahan. Oleh karena itu, didalam penyelesaian sengeketa konsumen dan perusahaan ditemukan jalan keluar dengan Alternatif Penyelesaian Sengketa melalui mekanisme negosiasi, yang merupakan istilah lain dari musyawarah untuk mufakat. One of the basic elements in the public welfare is so fulfill the basic needs which is the need for housing. Nowdays there are so many partieswhich gain a chance to open the business field as developer. The developer offers home ownership with mortgage system and its funding is supported by bank. This is one of the solutions for costumers who want to get a house immediately. Field work practice (PKL) is compulsory for students of Diploma Degree (D-3) Program of Law Faculty, Gadjah Mada University, as a requirement to get a degree of associate expert or paralegal. Therefore, the writer chose a field workpractice in CV. Rajawali Property, a company which runs in property field. The results of the field work practice showed that the process of home ownership with mortgage system arises a lot of problems which are needed to be solved. One of problems is default which is caused by breaking one of the agreement. In this case, the costumers do not meet the agreement attached on the engangement sale-purchase contract so that they cannot propose mortgage system. However, the developer hasalready built the house. In resolving the conflict between the customers and the developer, it is found the way out by applying alternative dispute settlements through negotiaton, or in orderwords, deliberation to reach consensus.
