PERAN DIREKTORAT JENDERAL BEA DAN CUKAI DALAM HUKUM KEPABEANAN TERHADAP KAWASAN BERIKAT PT LUNDIN INDUSTRY INVEST DITINJAU DARI UNDANG-UNDANG NOMOR 17 TAHUN 2006 TENTANG KEPABEANAN

Penelitian ini bertujuan untuk memperoleh gambaran yang jelas tentang peran Direktorat Jenderal Bea dan Cukai, kendala yang dilakukan, dan upaya dalam hukum kepabeanan kawasan berikat PT Lundin Industry Invest. Penelitian ini bersifat normatif empiris karena menggunakan data primer dan data sekunder. Data primer diperoleh dilapangan di Kantor Pelayanan dan Pengawasan Banyuwangi dengan teknik pengambilan sampel dengan menggunakan metode wawancara menggunakan pedoman wawancara terhadap narasumber ( 1 bagian urusan umum, 1 Kasubsi pelayanan dan perbendaharaan, 1 Kasubsi Kepatuhan Internal dan Penyuluhan. Data sekunder diperoleh dari kepustakaan dengan metode dokumentasi menggunakan studi dokumen terhadap bahan hukum primer sekunder kedua data tersebut dianalisis secara kualitatif dengan metode deskriptif berdasarkan cara berpikir induktif. Penelitian ini menunjukkan hasil Peran Direktorat Jenderal Bea dan Cukai Jatim II yang menugaskan Kantor Pelayanan dan Pengawasan Banyuwangi, sebagai kantor pelayanan yang letaknya strategis dalam pengawasannya maka dalam pemantauannya lebih detail. PT Lundin Industry Invest melakukan pelanggaran mengeluarkan barang dari kawasan berikat sebelum mendapatkan izin petugas bea cukai dikenakan sanksi sesuai dengan undang-undang kepabeanan. Kendala dan upaya dalam kawasan berikat yakni Sumber Daya Manusia dengan penambahan Sumber Daya Manusia, Skill dengan pusdikat kepegawaian, Letak impor barang yang jauh letak geografis lalu dilakukan penyegelan di pelabuhan Tanjung Perak, belum adanya CCTV maka disediakan, belum adanya IT inventory juga di tambahkan, pengaturan konversi barang yang tidak jelas maka dengan menerbitkan surat kepada PT Lundin untuk memberikan buku petunjuk konversi, uji coba Seat Trail sulit pengawasannya diatasi dengan Kapal Patroli. This research aims to gain a clear picture of the role of the Directorate- General of customs and Excise, a constraint is done, and the efforts in the legal customs bonded area PT Lundin Industry Invest. This research is empirical because it uses the normative primary data and secondary data. Primary Data obtained in field Service Offices and surveillance in Banyuwangi with sampling techniques using interviews using interview guides to the speaker (1 part 1 Public Affairs, Treasury Ministry and Kasubsi, 1 Kasubsi Internal Compliance and outreach. The secondary Data were obtained from the library with the method documentation using the study documents the primary legal materials against second secondary data were analyzed qualitatively descriptive method based on inductive way of thinking. This research shows the result of the role of the Directorate General of customs and Excise Jatim II who commissioned the Service Office and the supervision of Banyuwangi, With technique the sample by using centrifugal interview guidelines using interviews against affairs ( 1 part common affairs, 1 in department service and perbendaharaan, 1 in department compliance internal and elucidation. Data secondary obtained from kepustakaan by method documentation use study document on old law primary secondary both the data qualitative analysis method based on how a descriptive think inductive. The research indicated results role directorate general of customs and excise jatim II who commissioned service office and supervision banyuwangi, as service station that is located in the control of strategic then pemantauannya in more detail.
