Penelitian ini bertujuan untuk mengetahui, menganalisis, menelaah, dan memahami jikalau penarikan diri secara unilateral oleh Amerika Serikat tersebut bertentangan dengan asas good faith dan bagaimana konsekuensi atas penarikan diri Amerika Serikat terhadap Statuta Roma. Penelitian ini merupakan penelitian hukum normatif berdasarkan kerangka hukum internasional, penggunaan bahan hukum meliputi bahan hukum primer dan sekunder melalui teknik pengumpulan berupa studi kepustakaan. Pengolahan data dilakukan dengan metode kualitatif yaitu mengumpulkan data, mengklasifikasi, menguraikan dan mengevaluasi data dengan menggunakan ketentuan-ketentuan hukum yang berlaku untuk melihat kesesuaian atau sebaliknya untuk selanjutnya menetapkan kesimpulan untuk menjawab permasalahn penelitian. Penandatanganan suatu perjanjian merupakan langkah awal pengikatan diri suatu negara terhadap perjanjian itu. Negara tersebut berkewajiban untuk tidak melakukan perbuatan-perbuatan yang akan membatalkan maksud dan tujuan perjanjian itu sampai tiba saatnya negara tersebut menjelaskan secara jelas maksudnya untuk tidak menjadi pihak pada perjanjian tersebut. Itulah sebabnya perjanjian harus dilaksanakan dengan itikad baik. Konsekuensi penarikan diri Amerika Serikat ini dikaji dalam tiga hal yaitu secara politis, prosedural, dan substantif yang kesemuanya akan mempengaruhi posisi Amerikan Serikat dalam Pengadilan Internasional.

This study aims to find, to analyze, to examine and to understand if the unilateral withdrawal by the United States is contrary to the good faith principle and the consequences of the withdrawal of the United States to the Rome Statute. This research is a normative legal research based on the international law framework. The use of legal materials includes the primary and the secondary legal materials through the library research gathering techniques. Data processing is conducted by the qualitative method to collect, to classify, to describe and to evaluate the data by using the provisions of applicable law to check around the suitability or otherwise. Furthermore, it establishes a conclusion to answer the problems in this research. The signing of the agreement is the first step of binding of a state on the agreement. The State shall not perform acts that result in the cancellation of the intent and purpose of the agreement is to explain clearly state the intent to not be a party to such the agreement. It is the cause that the agreement should be implemented in good faith. The consequences of the withdrawal by the United States are examined in three phases, those are politically, procedurally, and substantively all of which will affect the position of the United States in the International Court.
