ANALISIS PELANGGARAN TERHADAP SUMPAH JABATAN OLEH PEJABAT NEGARA DI NEGARA HUKUM INDONESIA

Penulisan tesis ini bertujuan untuk menganalisis pelanggaran sumpah jabatan oleh pejabat negara di negara hukum Indonesia dengan ruang lingkup analisis; mengetahui kedudukan sumpah jabatan pejabat negara di negara hukum Indonesia, serta konsekuensi pelanggaran sumpah jabatan bagi pejabat negara. Metode penelitian yang digunakan adalah penelitian hukum normatif melalui pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus.Beberapa pendekatan tersebut digunakan dalam menganalisa pelanggaran sumpah jabatan oleh pejabat negara di negara hukum Indonesia, dengan sampel penelitian; sumpah jabatan Bupati, Anggota DPR, dan Hakim. Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa kedudukan sumpah jabatan adalah sebagai salah satu syarat sah memangku jabatan, governmental contract, dan bentuk pengawasan diri yang melekat.Hal tersebut disertai konsekuensi apabila melakukan pelanggaran sumpah jabatan pejabat negara (Bupati, Anggota DPR RI, dan Hakim) yaitu pemberhentian dari jabatan.

The writing of this thesis aims to analyze the breach of the oath of Office for State officials in Indonesia, with a parliamentary system, the scope of the analysis; knowing the position of the oath of Office in the system of State officials in Indonesia, as well as the consequences of violation of the oath of Office for State officials. The research method used in this thesis is normative legal research through the approach of legislation, and conceptual approach to approach the case. Some of the approaches used in analyzing of the breach the oath of office by state officials in the state of law of Indonesia, the research sample; the oath of Office the head of the region (particularly Regent), members of Parliament and judges. The results of research and analysis indicates that the position of the oath of Office as one of the conditions is valid to assume the Office, contact forms, and governmental oversight of the inherent self. Based on the provisions of law, the consequences of breach of the oath of Office of State officials (governors, members of parliament, and judges) is the dismissal from Office.
