PERTANGGUNGJAWABAN NOTARIS DALAM PENDAFTARAN FIDUSIA ONLINE TERHADAP PENERIMA FIDUSIA

Penelitian berjudul “Pertanggungjawaban Notaris Dalam Pendaftaran Fidusia Online Terhadap Penerima fidusia” bertujuan untuk mengetahui pertanggungjawaban notaris kepada penerima fidusia dalam proses fidusia online dan faktor-faktor pendukung serta penghambat dalam proses pendaftaran fidusia online. Penulisan ini bersifat deskriptif dengan penelitian yang dilakukan yaitu menggunakan penelitian kepustakaan dan penelitian lapangan. Penelitian kepustakaan yang diambil dari beberapa referensi serta penelitian lapangan dengan meneliti proses pendaftaran yang dilakukan notaris dikantornya. Hasil Penelitian menunjukan bahwa Surat Edaran Dirjen AHU Nomor 06.0T.03.01 tanggal 5 Maret 2013 mengatur pelaksanaan pendaftaran fidusia dengan sistem online. Proses pendaftaran ini dilakukan oleh notaris. Dilakukan pendaftaran oleh notaris dan pembuatan aktanya ini hanya sebatas syarat formil untuk memenuhi peraturan.Surat Edaran ini sebenarnya mengeliminasi keberadaan UUJF karena peraturan didalam Undang-Undang seharusnya lebih tinggi daripada Surat Edaran, untuk dapat mendaftarkan fidusia dasarnya adalah surat kuasa, Namun kuasa ini bersifat paksa karena tidak ada kesepakatan dan hanya mengikuti aturan dalam Undang-Undang. The study entitled \\"Fiduciary Responsibility Notary of Registration Online In Against Lenders\\" aims to find a notary public accountability to the lender in online fiduciary processes and factors supporting and inhibiting the fiduciary online registration process. This writing is descriptive research conducted with the use of library research and field research. Research literature are taken from several references and field research by investigating the notary registration process is done in his office. Research results show that Director General AHU of Circular Letter No. 06.0T.03.01 dated March 5, 2013 regulate the implementation of fiduciary registration with the online system. The registration process is done by a notary. Be registered by a notary and manufacture of this deed merely to meet the formal requirements of this Circular peraturan. This letters actually eliminate the existence UUJF because the rules in the Act should be higher than the Circular, to be able to register the power of attorney is essentially fiduciary, however this power is forcibly because there is no agreement and just follow the rules in the Act.
