PERAN AGEN INSPEKSI (REGULATED AGENT) BAGI KEAMANAN KARGO UDARA DALAM MENCIPTAKAN PERSAINGAN USAHA YANG SEHAT DI BANDAR UDARA SOEKARNO HATTA

Peraturanperaturantersebutbertujuanuntukmeningkatkankeamanandanmemberikandampakpositifterhad apindustripenerbangandanmasyarakat Indonesia, meskidemikian, halinibelumlahtercapaidalammasalahpengamanankargodanpos yang diangkutdenganpesawatudara. Kebijakanageninspeksi (Regulated Agent) telahberkali-kali mengundangprotes di lapanganataubandaraudaraSoekarno – Hatta. Sebagaiakibatnya, penerapanKeputusanDirekturJenderalPerhubunganUdaraNomor SKEP/255/IV/2011 tentangPemeriksaanKargodanPos yang DiangkutdenganPesawatUdaratelahberkali – kali mengalamipenundaan. Implementasikebijakanterkaitageninspeksi (Regulated Agent) ditengaraimenyebabkanpenumpukankargodanpos, terutamaakibatlambatnya proses pemeriksaan. Sementaraitubeberapaasosiasisektoraldalamnegeriseperti: AsosiasiLogistikdan Freight/Forwarder Indonesia (ALFI), Asosiasi Perusahaan JasaEkspres Indonesia (ASPERINDO), AsosiasiPengusahaKawasanBerikat (APKB), Serikat Perusahaan Pers (SPS) dan PT Pos Indonesia menyampaikantidakterdapatnyaperubahanpengawasankeamanankargodanpos yang signifikanolehageninspeksi (regulated agent). Yang terjadihanyalahkenaikanbiaya screening dariRp 60 per kilogram menjadiantaraRp 440 sampaiRp 1,050 per kilogram sudahtermasukPPn. Hasilpenelitianhukum yang dilakukanolehpenulismenunjukkanbahwapemeriksaankeamanan yang dilakukanolehAgenInspeksi (Regulated Agent) di kawasanBandaraInternasionalSoekarno – Hattaadalahdiragukanhasilnya. Selanjutnya, dalamkegiatanusahaAgenInspeksi (Regulated Agent) di Bandar UdaraInternasionalSoekarno – Hattaditemukanpraktekpersainganusaha yang tidaksehat, yang melanggarUndang-UndangNomor 5 Tahun 1999 karenaterdapatpenguasaanpasarberbentukmonopolidantarif yang diberlakukan. Gunameningkatkanpersainganusaha di bidangkeamanankargoudarapemerintahharusberperanaktifdalammengawasikinerjaageninspek si (Regulated Agent).
Cargo security is one of the main elements of aviation safety and security. Aviation safetyshould bethe responsibility ofgovernment, aviation companies and public. Aligned with this matter, the government has issued series of regulation that are related with the implementation of the National Civil Aviation Security Programme. The regulations aim to improve safety and provide a positive impact to aviation industry and Indonesian people. Thus far, however, cargo security has not been achieved successfully. Regulated Agent in Soekarno–Hatta airport has received many protests. Consequently, the implementation of Director General of Civil Aviation Regulation No. SKEP/255/IV/2011 concerning Inspection for Cargo and Post Carried by Aviation has been repeatedly canceled. The implementation of Regulated Agent regulation is argued to cause delay in cargo and post delivery, particularly due to the slow inspection process. Meanwhile, domestic sector associations, such as: Logistics and Freight Association / Forwarder Indonesia (ALFI), Association of Indonesian Express Service (ASPERINDO), Employers' Association of Bonded Zone (APKB) , United Press Company (SPS), and PT Pos Indonesia expressed the absence of significant changes that made cargo security inspection better. What happened is only increase of cost for screening from Rp 60 per kilogram to a range between Rp 440 to Tp 1,050 per kilogram (including VAT). The results of legal research conducted by the authorexhibited that the security screening undertaken by Regulated Agent in the Soekarno–HattaInternational Airportshowed doubtful results. Furthermore, the Regulated AgentinSoekarno - HattaInternational Airport may performed unfair competition, thus violates Law No. 5 of 1999,duetotheexistenceof marketdomination and monopoly tariffs. In order toincrease competition in air cargo security, the government should play an active role in monitoring the performance of Regulated Agents
