Penelitian yang berjudul “Perlindungan Hukum Bagi Pembeli Dalam Jual Beli Satuan Rumah Susun Dengan Sistem Pemesanan (Studi Kasus Putusan Pengadilan Negeri Jakarta Selatan Nomor 286/Pdt.G/2012/Jkt-Sel)” bertujuan untuk mengetahui dan mengkaji penyebab terjadinya permasalahan dalam jual beli rumah susun dengan sistem pemesanan dan bentuk perlindungan hukum bagi pembeli rumah susun dalam jual beli dengan sistem pemesanan. Penulisan ini bersifat yuridis normatif, yaitu penelitian hukum terhadap bahan pustaka atau data sekunder. Data yang digunakan dari bahan hukum primer yaitu peraturan perundang-undangan, perjanjian dan putusan hakim yang terkait. Untuk melengkapi data yang diperoleh, penelitian ini ditunjang dengan wawancara terhadap 3 (tiga) narasumber. Seluruh data yang terkumpul dianalisis dengan metode kualitatif. Hasil penelitian menunjukkan bahwa permasalahan yang terjadi disebabkan oleh kurang pahamnya konsumen terhadap prosedur jual beli rumah susun/apartemen dengan sistem pemesanan. Selain itu, dalam tahap PPJB konsumen tidak diberikan cukup waktu untuk membaca dan mempelajari terlebih dahulu PPJB tersebut. Keterlambatan serah terima disebabkan oleh wanprestasinya pengembang karena kurangnya estimasi waktu yang dilakukan pengembang, sedangkan untuk keterlambatan penyerahan sertifikat sangat tergantung dengan Kantor Pertanahan. Permasalahan mengenai perbedaan luasan terjadi karena banyak konsumen yang kurang memahami mengenai semigross dan luas nett, serta hanya berpedoman pada angka luasan dalam PPJB saja. Bentuk perlindungan hukum bagi pembeli satuan rumah susun dalam jual beli dengan sistem pemesanan adalah dengan dibuatnya PPJB sebagai bentuk upaya perlindungan hukum prefentif. Jika dalam pelaksanaan terdapat hal yang tidak sesuai dengan perjanjian maka dapat dilakukan pengajuan gugatan sebagai upaya perlindungan hukum represif. Selain itu konsumen juga dapat menuntut hak-haknya sesuai dengan Pasal 4 Undang-undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. The research entitled \\"Legal protection for Buyer in the Sale and Purchase of Apartment Units with Booking System (A Case Study of the Verdict of South Jakarta District Court Number 286/Pdt.G/2012/Jkt-Sel)\\" is aimed at identifying and examining the causes of the problems in the sale and purchase of apartment with booking system and the form of legal protection for buyers in the sale and purchase of apartment with booking system. This research is a juridical normative research, that is a legal research on library materials or secondary data. The data used from primary legal materials included laws and regulations, agreements, and related verdict. This research was supported with interviews with three resource persons. The data obtained were analyzed using qualitative method. The results of research indicated that problems might occur due to consumer’s lack of understanding of the procedure of sale and purchase apartments with booking system. In addition, in the phase of the Sale and Purchase Commitment Agreement (PPJB) consumers are not given enough time to read and study the PPJB in advance. Handover delay is caused by developer in default because the lack of estimated time from the developer, while the late transfer of the certificate is highly dependent on the Land Registry Office. The problem regarding land size occurs because many consumers did not fully understand semigross and net size and just based on the size number in the PPJB. The form of legal protection for buyers of apartment units in in the sale and purchase with booking system is by making PPJB as a form of preventive legal protection. If there are things in the implementation that are not in accordance with the agreement, a lawsuit can be filed as a repressive legal protection. In addition, consumers can also claim their rights in accordance with Article 4 of Act No. 8 of 1999 concerning Consumer Protection. Key words: Legal Protection, Sale and Purchase, Apartment Units
