PERLINDUNGAN HUKUM BAGI KONSUMEN PENGGUNA JASA PARKIR DI TEPI JALAN UMUM KAWASAN MALIOBORO KOTA YOGYAKARTA

Kawasan Malioboro merupakan salah satu ikon kota yogyakarta dan merupakan destinasi wisata favorit bagi wisatawan baik lokal maupun asing. Saat ini Kawasan Malioboro dihadapkan pada berbagai macam permasalahan. Salah satu permasalahan tersebut yaitu mengenai perparkiran. Pelanggaran yang dilakukan oleh juru parkir di Kawasan Malioboro tidak jarang merugikan konsumen pengguna jasa parkir, utamanya masalah retribusi parkir. Belum lagi masalah pelayanan dan keamanan saat menggunakan layanan jasa parkir di Kawasan Malioboro, khususnya Di Tepi Jalan Umum. Dari hal tersebut penulis tertarik untuk meneliti lebih lanjut mengenai pelaksanaan perlindungan hukum bagi konsumen pengguna jasa parkir di Tepi Jalan Umum Kawasan Malioboro, faktor-faktor penyebab sulitnya pelaksanaan perlindungan hukumnya, serta upaya yang dapat dilakukan konsumen pengguna jasa parkir di Tepi Jalan Umum kawasan Malioboro terkait pelanggaran hak-haknya. Sifat penelitian yang digunakan adalah empiris. Penelitian hukum empiris yaitu penelitian hukum yang memperoleh data dari sumber hukum primer. Jadi, penelitian ini menitikberatkan pada penelitian lapangan untuk memperoleh data primer. Untuk melengkapi data dilakukan studi kepustakaan untuk memperoleh data sekunder. Hasil penelitian ini, penulis dapat menyimpulkan bahwa saat ini perlindungan hukum terhadap konsumen pengguna jasa parkir di Tepi Jalan Umum Kawasan Malioboro telah terlaksana dengan baik dan sesuai dengan ketentuan di dalam Peraturan Daerah Nomor 18 Tahun 2009 Tentang Penyelenggaraan Perparkiran. Namun yang perlu diperhatikan adalah masih sering terjadi pelanggaran yang dilakukan oleh oknum juru parkir yang merugikan konsumen. Faktor penyebab sulitnya pelaksanaan perlindungan hukum di Kawasan Malioboro salah satunya yaitu rendahnya pengetahuan dan minat konsumen terhadap hak-haknya. Konsumen pengguna jasa parkir yang mengalami kerugian dapat menempuh mekanisme penyelesaian sengketa secara musyawarah yang telah disiapkan oleh pemerintah. The Malioboro Region are one of the icon of Yogyakarta City and as a favourite tourism destination for touristeither from local and foreign. Nowadays, Malioboro area faced by many problem. One of them is about parking service. Violation commited by the parking operator in the Malioboro area not rarely harm the consumer, especially for parking fees. Not to mention the issue of service and security while using the parking services in the Malioboro area, especially at edges of public roads. From that problems authors are interested in researching more about the implementation of legal protection for consumers parking service users on the Public Street at Malioboro area, The factors that cause difficulty to implementation of legal protection, as well as the efforts of consumer service users can be done on the public road parking Malioboro related violations of his rights. The nature of research used is empiric. Laws empirical research means legal research that obtain data from primary law source. So, this research focused on field research to obtain primary data. To furnish the data conducted literature study to obtain secondary data. The results of this research, the authors can conclude that the current legal protection of the consumer service users on the Public Street parking at Malioboro area has been carried out properly and in accordance with the provisions in the Regulation Number 18 year 2009 about the implementation of parking service. However for note, there’s still frequent violations committed by members of the parking operator that may harm the consumer. One of the factors that cause difficulty to implementation of legal protection in the Malioboro area is because consumer lack in interest and knowledge of his rights. The parking service users consumers that suffer losses can take the consumer dispute resolution mechanism in the deliberation that has been prepared by the Government.
