ANALISIS HUKUM TERHADAP WANPRESTASI PIHAK PENJUAL DALAMPERJANJIAN JUAL BELI APARTEMEN HOLLYWOOD RESIDENCE

Perjanjian jual beli apartemen Hollywood Residence yang dilakukan oleh konsumen dengan developer pada tahun 2005 merupakan perjanjian yang sangat merugikan bagi kepentingan dan hak-hak konsumen. Dalam perjanjian ini pihak developer telah melakukan wanprestasi kepada pembeli dengan tidak menepati janjinya untuk menyelesaikandan menyerahkan unit tepat pada waktunya, sesuai dengan apa yang di perjanjikan dalam perjanjian tersebut. Ganti kerugian, biaya dan bungapun sampai sekarang tidak pernah direalisasikan oleh pihak developer Apartemen Hollwood Residence. Tujuan penelitian ini adalah untuk mengetahui tanggungjawab penjual dan untuk mengetahui perlindungan hukum konsumen serta kedudukan hukum para pihak dalam perjanjian jual beli apartemen Hollywood residence dengan adanya developer baru yang meminta pembaharuan perjanjian. Metode penelitian yang dilakukan adalah yuridis empiris, yaitu suatu pendekatan yang dilakukan untuk menganalisis tentang sejauh mana peraturan perundang – undangan atau hukum yang sedang berlaku secara efektif. Penelitian dilakukan di Apartemen Hollywood Residence. Penelitian ini melihat dari permasalahan dalam pelaksanaan jual beli Apartemen Hollywood residence. Dari hasil penelitian dapat disimpulkan pertama pihak penjual tidak bertanggungjawab, karena telah tidak memenuhi apa yang diperjanjikan kepada pihak konsumen untuk menyelesaikan dan menyerahkan unit apartemen atau disebut telah wanprestasi, konsumen juga tidak mendapat perlindungan hukum semestinya, dan kedudukan hukum para pihak sangat tidak seimbang, hal ini dirasakan berat sebelah antara hak dan kewajibannya. Konsumen lebih banyak di bebani dengan kewajiban - kewajiban baru, sementara hak – hak yang seharusnya diperoleh tidak direalisasikan oleh developer.

The sale and purchase agreement of Hollywood Residence conducted by costumer and developer in 2005 was harm for the importance and the rights of the costumer. In this agreement, the developer has perform default to the costumer by unfulfill its commitment to complete and deliver the unit in time. Compensation, expense, and interest are not achieved by the developer until this day. The aim of this study is to find out the seller resposibility and the law protection for the costumer and both parties law position in sale and purchase agreement of Hollywood Residence Apartment by the existence of new developer that request the agreement renewal. The research method is using empiric judicial, an approach that carried out to analyze how far the law regulations acts effectively. The research is conducted in Hollywood Residence Apartment and observed the implementation of its sale and purchase. The conclusion of the research is the seller inresponsibility due to the unfulfillment of its agreement to complete and to deliver the apartment unit, or default, to the costumer. The costumer does not gain law protection properly and the law position of both parties are not equal, therefore it is bias between the rights and obligation. The costumer is burdened more by new obligation, meanwhile the expected rights are not achieved by the developer.
