Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto adalah salah satu buku yang dinyatakan larangan beredar oleh Kejaksaan Agung Republik Indonesia (Kejaksaan Agung) melalui Keputusan Jaksa Agung Nomor : Kep-139/A/JA/12/2009 tentang Larangan Beredar Barang Cetakan Buku Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto Karangan John Roosa Penerjemah Hesri Setiawan Penerbit Institut Sejarah Sosial Indonesia JL. Pinang Ranti No. 3 Jakarta 13560 Penerbit Hasta Mitra JL. Duren Tiga Selatan No. 36 Jakarta Selatan di Seluruh Indonesia (Keputusan Jaksa Agung No : Kep-139/A/JA/12/2009). Bagian Konsiderans huruf a Keputusan Jaksa Agung No : Kep-139/A/JA/12/2009 menyatakan bahwa indikator kebijakan larangan beredar buku Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto ini adalah mengganggu ketertiban umum. Paragraf 12 the Human Rights Committee General Comment No. 34 on Freedom Opinion and Expression (the Human Rights Committee General ! 2! Comment No. 34) menyatakan bahwa Artikel 19 Paragraf 2 the ICCPR meliputi berbagai bentuk ekspresi meliputi buku - buku. Berdasarkan pengertian paragraf 12 the Human Rights Committee General Comment No. 34, buku adalah salah satu bentuk dan cara the freedom of expression yang dilindungi dan diatur the ICCPR. Negara Republik Indonesia telah meratifikasi the International Covenant on Civil and Political Rights melalui Undang - undang No. 12 Tahun 2005 tentang Pengesahan International Covenant on Civil and Political Rights (the ICCPR). Hal ini menimbulkan konsekuensi bahwa Pemerintah Negara Republik Indonesia terikat untuk melaksanakan kewajiban - kewajibannya berdasarkan the ICCPR. Kebijakan larangan beredar buku Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto harus dapat diterapkan secara konsisten berdasarkan pembatasan the freedom of expression yang diatur the ICCPR.

The Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto were one of the books which banned by the Attorney General of the Republic Indonesia thru the Act of General Attorney Number Kep-139/A/JA/12/2009 toward the Banning of the Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto Featuring John Roosa Interpreted by Hesri Setiawan Published by the Cooperation amongst of the Institut Sejarah Sosial Indonesia Publisher Jl. Pinang Ranti No. 3 Jakarta 13560 and the Hasta Mitra Publisher Jl. Duren Tiga Selatan No. 36 South Jakarta Across the Indonesia Teritorial (the Act of General Attorney No. Kep-139/A/JA/12/2009). The section a of the consideration of the Act of General Attorney No. Kep-139/A/JA/2009 stated that public order were the main reasoning of the Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto Book Banning Policy. Paragraph 12th of the Human Rights Committee General Comment No. 34 on Freedom Opinion and Expression (the Human Rights Committee General ! 2! Comment No. 34) stated that the Article 19 Paragraph 2 of the International Covenant on Civil and Political Rights (the ICCPR) protects all forms of expression, which means of expression include books. Upon this Paragraph 12 of the Human Rights General Comment No. 34, books were the form and manner of the freedom of expression which protected and recognized by the Article 19 Paragraph 2 of the International Covenant on Civil and Political Rights. The Republic of Indonesia has ratified the ICCPR thru the Law Number 12th Years 2005 toward the Ratification of the International Covenant on Civil and Political Rights (the Law Number 12th Years 2005). This ratification arouse consequences that the Government of the Republic of Indonesia bounded by the obligation under the ICCPR. The Dalih Pembunuhan Massal : Gerakan 30 September dan Kudeta Soeharto Book Banning Policy should be applied consistently by the limitation on the freedom of expression under the ICCPR.
