PROSES PENGADILAN HUKUM PERNIKAHAN SESAMA JENIS DI AMERIKA SERIKAT: REAKSI NEGARA-NEGARA BAGIAN

khususnya setelah adanya keputusan pengadilan tentang masalah tersebut di Hawaii. Seiring waktu, topik ini telah berkembang dan menyebar ke seluruh negara bagian sebagai debat dengan perubahan pendukung dan penolak. Tesis ini akan mempelajari perkembangan topik tersebut dengan latar belakang kerusuhan Stonewall pada era 1960an. Peristiwa tersebut menandai pergerakan gay dan lesbian modern, yang berkontribusi pada kemajuan pernikahan sesama jenis. Reaksi negara-negara bagian adalah fokus tesis ini. Metodologi penelitian perpustakaan diterapkan karena semua data dalam penelitian ini ditulis teks. Banyak bahan-bahan tertulis yang diperoleh dari buku, artikel, termasuk bahan berbasis internet. Metode lain yang digunakan dalam penelitian ini adalah metode kualitatif deskriptif, di mana semua data yang diperoleh dianalisis dan disajikan secara deskriptif. Karena pernikahan merupakan salah satu masalah hak kewarganegaraan dan pernikahan sesama jenis yang diminta oleh kaum gay dan lesbian didasarkan pada aspek kesetaraan, maka penulis memakai teori terkait kesetaraan hak oleh Richard D. Mohr. Mohr menyatakan bahwa status seseorang sebagai gay dan lesbian tidak bisa dijadikan alasan atas menganggap seseorang lebih rendah. Penganggapan tersebut bisa diberikan hanya jika seseorang telah atau belum melakukan hal yang akan membuatnya lebih rendah, bukan hanya berdasarkan status. Sekarang ini, pernikahan sesama jenis telah sah di tiga belas negara bagian di Amerika, dan beberapa negara bagian lain mengakui hubungan sesama jenis dengan nama domestic partnership dan civil union. Jumlah yang meningkat cepat sejak 2004 saat pertama kali pernikahan sesama jenis sah di Massachusetts ini diikuti oleh menurunnya jumlah negara bagian yang melarang jenis pernikahan tersebut. Hal ini terjadi karena orang semakin lebih bertoleransi dan nyaman terhadap orang gay dan lesbian, dan di sisi lain gay dan lesbian juga telah belajar “keluar” ke masyarakat. Dalam hal ini, pemuda menjadi grup tertinggi dalam hal bertoleransi dengan mereka.

Same sex marriage has been a national issue in the United States of America particularly after the decision from court of a litigation concerning the subject in Hawaii. Over time, this subject has grown and spread across states as a debate with the mobilizing numbers of supporters and opponents. This thesis will examine about the development of the issue with the background of Stonewall riots in around 1960s. This event has marked the modern gay and lesbian movement, which contributed to the progress of same sex marriage. The states’ reaction will be the focus of this research. Library research methodology is applied since all the data in this research are written text. Many written materials are acquired from books, articles, including internet-based materials. Another method used in this research is descriptive qualitative method, by wich all the data obtained are analyzed and presented descriptively. As marriage is one of civil right issues and same sex marriage which is demanded by the gay men and lesbians is relied on equality aspect, this research uses the theory related to equality of rights by Richard Mohr. Mohr argues that in a level of equality of rights, status of someone as a gay or lesbian should not become a reason for others to give someone less regard than others. A less regard should be given only to those who have or have not done something that will make them less regarded, not to those only based on the status. At present time, same sex marriage is already legal in thirteen states in the United States and several more states apply domestic partnership and civil unions to recognize same sex relationship. This fast, increasing number since 2004 from where the first time same sex marriage was legal in Massachusetts, is followed by the decreasing number of states who ban such marriage. This happens as more people have become more tolerant and comfortable to gay men and lesbians, as on the other hand, the gay men and lesbians have learned to “come out” to the society. In this case, youth show as the highest group in being tolerable to them.
