KEPEMILIKAN REKAM MEDIS MENURUT UNDANG UNDANG NOMOR 29 TAHUN 2004 TENTANG PRAKTIK KEDOKTERAN DI RSUD KAREL SADSUITUBUN LANGGUR KABUPATEN MALUKU TENGGARA

Tujuan dari penelitian ini adalah untuk mengetahui kepemilikan rekam medis di Rumah Sakit Umum Daerah Karel Sadsuitubun, prosedur pelaksanaan dalam permintaan isi rekam medis di Rumah Sakit Umum Daerah Karel Sadsuitubun, serta penyelesaian sengketa dalam permintaan isi rekam medis di Rumah Sakit Umum Daerah Karel Sadsuitubun. Penelitian ini merupakan penelitian hukum normatif empiris, yang menganalisis kepemilikan rekam medis menurut Undang-undang nomor 2 tahun 2009 tentang Praktik Kedokteran di Rumah Sakit Umum Daerah Karel Sadsuitubun. Penelitian ini melibatkan 25 responden. Data primer yang diperoleh dari hasil penelitian lapangan dianalisis secara kualitatif dan disajikan secara diskriptif. Berdasarkan hasil penelitian, Kepemilikan Rekam Medis di Rumah Sakit Umum Daerah (RSUD) Karel Sadsuitubun telah mengimplementasikan ketentuan Undang-undang Nomor 29 tahun 2004 tentang Praktik Kedokteran Pasal 47 dan Peraturan Menteri Kesehatan RI Nomor 269/Menkes/Per/III/2008 tentang rekam medis Pasal 12. Dokumen rekam medis milik rumah sakit dan isi rekam medis milik pasien dapat diberikan dalam bentuk resume.Prosedur permintaan isi rekam medis di Rumah Sakit Umum Daerah (RSUD) Karel Sadsuitubun dilakukan melalui permohonan tertulis kepada direktur rumah sakit untuk permintaan pengadilan, sedangkan untuk klaim asuransi dilakukan di instalasi rekam medis dengan memberikan surat pengantar dari perusahan asuransi dan foto copy kwitansi pembayaran selama dirawat, untuk rujukan pasien atau keluarganya ke rumah sakit lain pasien atau keluarganya mengisi formulir (bon permintaan) di instalasi rekam medis. Penyelesaian sengketa permintaan isi rekam medis di RSUD Karel Sadsuitubun menggunakan cara mediasi yaitu dengan bernegosiasi dengan pihak pasien atau keluarganya untuk mencari solusi terbaik dalam penyelesaian sengketa tersebut para pihak duduk secara bersama-sama untuk menyelesaikan permasalah yang terjadi.

The purpose of this study was to determine the ownership of medical records at the General Hospital Karel Sadsuitubun, the operational procedures in the content of medical records requests at the General Hospital Karel Sadsuitubun, as well as the means of dispute resolution in the contents of medical records requests at General Hospital Karel Sadsuitubun. 2 This study is an empirical study of normative law, which analyzed the medical records of ownership under Law 9 year 2009 on the practice of medicine at the General Hospital Karel Sadsuitubun. The study involved 25 respondents. Primary data were obtained from the results of the field study were analyzed qualitatively and presented descriptively. Based on the results of the study, in the Medical Record Ownership Regional General Hospital (Hospital) Karel Sadsuitubun has implemented the provisions of Act Number 29 year 2004 concerning Article 47 of the Medical Practice and Health Ministerial Regulation Number 269/Menke /Per/III/2008 on medical records Article 12. Medical record documents and contents owned by the hospital medical records belong to the patient can be given in the form of a resume. Contents of medical records request procedure at the Regional General Hospital (Hospital) Karel Sadsuitubun done through a written request to the director of the hospital to a court order, while for insurance claims made in the installation of medical records by providing a letter from the insurance company and a copy of the payment receipt during care , for the referral of patients or their families to other hospital patients or their families fill out a form (bon demand) in the medical record installation. Disputes relating to the content request medica patient or family to find the best solution in resolving the dispute the parties sit together to resolve the problem as it occurs.
