Tujuan Penelitian tesis ini adalah untuk mengetahui perlindungan hukum terhadap ahli waris merek “PURA DEWA”+Lukisan atas adanya iktikad buruk ahli waris lainnya dan untuk mengetahui ada tidaknya unsur iktikad tidak baik dalam pendaftaran merek pada putusan yang terkait dengan kasus merek “PURA DEWA”+Lukisan. Penelitian hukum ini merupakan penelitian hukum kombinasi normatif-empiris. Tipe pendekatan penelitian hukum ini adalah Judicial Case Study, yaitu studi kasus hukum karena objek penelitian diambil dari suatu konflik yang diselesaikan melalui putusan pengadilan. Hasil dari penelitian dan pembahasan ini menunjukkan bahwa, perlindungan hukum terhadap Ahli waris merek “PURA DEWA”+Lukisan telah diberikan perlindungan hukum oleh Pasal 68 ayat (1) Undang-Undang No. 15 Tahun 2001 tentang Merek. Perlindungan hukum tersebut dikuatkan dengan Pasal 834 Burgelijk Wetboek. Mengenai ada atau tidaknya unsur iktikad tidak baik dalam pendaftaran merek pada putusan yang terkait dengan kasus ini, ditinjau dari Pasal 4 Undang-Undang No 15 Tahun 2001 tentang Merek dapat dikatakan bahwa pendaftaran dan pengalihan merek yang dilakukan oleh pihak Tergugat terdapat iktikad tidak baik, karena tidak memenuhi unsur iktikad baik yang disebutkan dalam Penjelasan Pasal 4.

The research objective of this thesis is to determine the legal protection of the brand heirs \"PURA DEWA”+Painting against the bad faith on the other heirs and to determine whether there is bad faith element in the trademark registration on the decision related to the case of the brand \"PURA DEWA\"+Painting. The study of law is a combination of normative-legal research empirically. Type of legal research approach is Judicial Case Study, the study of case law as the research object taken from a conflict is resolved through a court ruling. The results of the study shows that the legal protection of the brand Heirs \"PURA DEWA\"+Painting has been provided by Article 68 paragraph (1) of Law No. 15 of 2001 regarding Marks. The legal protection is also strengthened by Article 834 Burgelijk Wetboek. Regarding whether there is an element of bad faith or not in the registration of the trademark in the decision related to the case, in terms of Article 4 of Law No. 15 of 2001 concerning on Marks can be concluded that the Defendants have not a good faith in register and transfer the brands because their action did not meet the elements of a good faith based on the explanation of Article 4.
