STUDI KOMPARISI PERLINDUNGAN HUKUM BAGI PEKERJA OUTSOURCING SETELAH LAHIRNYA PUTUSAN MAHKAMAH KONSTITUSI NOMOR 27/PUU-IX/2011 DI PT. GARDA TOTAL SECURITY

2012 | Tesis | S2 Magister KenotariatanPenelitian dengan judul ini bertujuan untuk mengetahui perlindungan hukum bagi pekerja outsourcing sebelum dan sesudah berlakunya Putusan Mahkamah Konstitusi Nomor 27/PUU-IX/2011 di PT. Garda Total Security, untuk mengetahui bentuk wanprestasi yang dilakukan para pihak dalam praktik outsourcing di PT. Garda Total Security, serta untuk mengetahui upaya hukum yang dilakukan oleh pekerja outsourcing dalam hal PT. Garda Total Security melakukan wanprestasi. Penelitian ini menggunakan pendekatan yuridis empiris. Data yang dipergunakan dalam penelitian ini adalah data primer dan data sekunder. Data tersebut dikumpulkan melalui penelitian lapangan dengan teknik wawancara dan penelitian kepustakaan dengan teknik studi dokumenter. Subjek penelitian ini dibagi dua, yaitu responden dan narasumber. Responden terdiri dari 5 (lima) pekerja outsourcing yang telah bekerja di perusahaan outsourcing minimal 1 (satu) tahun dan pejabat PT. Garda Total Security. Narasumber terdiri dari pimpinan perusahaan pemakai jasa pekerja outsourcing dan pejabat Dinas Tenaga Kerja dan Sosial Kabupaten Sleman. Penelitian responden menggunakan teknik non probability sampling. Jenis pengambilan sampel yang digunakan adalah purposive sampling. Data yang diperoleh dianalisa dengan cara kualitatifkomparatif. Hasil penelitian menunjukkan bahwa Perjanjian Kerja Waktu Tertentu tetap tidak mencantumkan adanya pengalihan perlindungan hak-hak bagi pekerja yang obyek kerjanya tetap ada, walaupun terjadi pergantian perusahaan penyedia jasa pekerja setelah lahirnya Putusan Mahkamah Konstitusi Nomor 27/PUU- IX/2011 di PT. Garda Total Security. Para pihak juga melakukan wanprestasi berupa melaksanakan apa yang diperjanjikan tapi tidak sempurna dan tidak melaksanakan apa yang disanggupi akan dilakukan dalam praktik outsourcing di PT. Garda Total Security. Upaya hukum yang dilakukan oleh pekerja outsourcing dalam hal PT. Garda Total Security melakukan wanprestasi adalah Musyawarah Mufakat dan penyelesaian perselisihan dengan UU No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial.

Garda Total Security wanprestasi do. This study uses empirical juridical approach. Data used in this study is the primary data and secondary data. Data were collected through field research by technique of an interview and library research techniques of documentary studies. The subject of this study was divided, the respondents and interviewees. Respondents consisted of 5 (five) workers outsourcing who has worked in the company of outsourcing at least one (1) year and officials in PT. Garda Total Security. Interviewees consisted of the Head Company as a User of outsourcing workers and Official of Dinas Tenaga Kerja dan Sosial Kabupaten Sleman. This study uses non-probability sampling, the sampling technique using a purposive sampling method. The data obtained were analyzed by qualitative comparative. The results showed that Definite Period of Labor Agreement does not include any transfer of rights protection for workers who work object persists, despite going on the turn of a company provider after the inception of the workers of the Constitutional Court Verdict No. 27/PUU-IX/2011 in PT. Garda Total Security. The parties also do wanprestasi liked be carrying out what is exchanged but not perfect and did not carry out what they will be made in the practice of outsourcing in PT. Garda Total Security. Legal efforts undertaken by workers of outsourcing in terms of PT. Garda Total Security performs wanprestasi's Deliberations and Consensus solution to the dispute with Act No. 2 of 2004 concerning the Industrial Relations Disputes Settlement.
