KAJIAN POLITIK HUKUM TENTANG PERLINDUNGAN HAK BERSERIKAT BURUH DI INDONESIA

Penelitian ini bertujuan untuk mengkaji tentang politik hukum perburuhan di Indonesia dalam melindungi hak berserikat bagi pekerja/buruh, baik dalam tataran implementasi politik hukum dalam menjamin hak berserikat bagi pekerja/buruh, maupun peran Pemerintah dalam menjamin terlaksananya hak berserikat bagi pekerja/buruh tersebut. Penelitian ini dilaksanakan dengan metode pengumpulan data melalui penelitian lapangan (field reseacarh) yang menggunaan teknik wawancara mendalam dengan pihak-pihak terkait. Penelitian ini juga menggunakan metode penelitian kepustakaan (library research) sebagai penunjang. Data penelitian yang diperoleh, dimaknai sebagai landasan analisis penelitian yang kemudian diuraikan berdasarkan teori-teori politik hukum sehingga melahirkan analisis data yang bersifat deskriptif kualitatif sesuai dengan tujuan penelitian. Dari hasil penelitian ini, diperoleh kesimpulan sebagai berikut : Pertama, politik perburuhan dalam perlindungan hak berserikat buruh di Indonesia, berbeda disetiap masa, baik pada masa Orde Lama Soekarno, Orde Baru Soeharto maupun Orde Reformasi sekarang ini. Implementasi politik hukum perburuhan belum sepenuhnya menjamin dan melindungi terlaksananya hak berserikat bagi buruh. Poitik hukum perburuhan akan dapat diimplementasikan dengan baik, ketika pekerja/buruh diberikan peran dan partisipasi dalam perumusan kebijakan perundang-undangan yang menyangkut kepentingan buruh itu sendiri. Kedua, Peran dan keterlibatan Pemerintah khususnya dalam mejamin hak terlaksananya kebebesan berserikat, masih sangat minim. Hal tersebut terlihat dari upaya pemerintah yang lamban dan pasif disetiap kasus-kasus pelanggaran berserikat yang terjadi. Hal ini pula yang membuat tingkat kepercayaan serta harapan serikat pekerja/serikat buruh terhadap peran pemerintah, semakin menurun, sehingga membuat serikat pekerja/serikat buruh lebih memilih untuk melakukan upaya perlindungan terhadap kebebasan berserikat dengan caranya sendiri.

This study aims to examine the politics of law on the protection of unionization rights of indonesia workers, both in the level of the implementation of politics of law on the protection of unionization rights of indonesia workers, as well as the role of government in ensuring the implementation of politics of law on the protection of unionization rights of indonesia workers. The research was carried out by the method of data collection through field research which uses the technique indepth interviews with relevant parties. This study also uses research methods library research as a support. The research data obtained, interpreted as a cornerstone of research and analysis outlined by the politics of law theories that gave birth to the descriptive data analysis in accordance with the purpose of qualitative research. From these results, the conclusion as follows : First, the politics of law on the protection of unionization rights of indonesia workers, is different every time, both in the old order of Sukarno, Soeharto's new order and the order of the Reformation today. Politics of law implementation not fully guarantee and protect the implementation of politics of law on the protection of unionization rights of indonesia workers. Poitics of law will be implemented properly, when the workers is given the role and participation in the formulation of policy and laws concerning the interests of workers them selves. Second, the role and involvement of government in particular in ensuring the implementation of the politics of law on the protection of unionization rights of indonesia workers, is still very minimal. It is seen from the government's efforts to slow and passive in every case of association violations that occurred. This also makes the level of trust and expectations of trade unions / labor unions against the government's role, decline, thus making the trade/labor unions prefer to make efforts to protect the unionization rights of indonesia workers.
