PENGARUH KEPUTUSAN KULTURAL MAJELIS RAKYAT PAPUA NOMOR III/KK-MRP/2009 TENTANG KEBIJAKAN KHUSUS DALAM RANGKA KEBERPIHAKAN, PERLINDUNGAN DAN PEMBERDAYAAN ORANG ASLI PAPUA TERHADAP KINERJA KERJA PEMERINTAHAN DAERAH

Penelitian ini mengkaji tentang pengaruh keputusan kultural Majelis Rakyat (MRP) Papua sebagai bahan pertimbangan dalam menetapkan dan melaksanakan kebijakan penyelenggaraan pemerintahan daerah dalam hal pemberdayaan, perlindungan dan keberpihakan terhadap orang asli Papua dalam wadah UndangUndang Republik Indonesia Nomor 21 Tahun 2001Tentang Otonomi Khusus Bagi Provinsi Papua sebagaimana yang telah diubah dengan Undang-Undang Republik Indonesia Nomor 35 Tahun 2008 Tentang Otonomi Khusus Bagi Provinsi Papua dan Provinsi Papua Barat, bertujuan untuk meneliti sejauh mana pemerintah daerah mengambil kebijakan dan bagaimana efektivitas kebijakannya dengan kewenangan yang didelegasikan dengan mengacu pada keputusan tersebut. Dalam memposisikan konstruksi teoritisnya, berangkat dari konsep bernegara khususnya hubungan kewenangan dalam negara kesatuan dengan posisi MRP sebagai lembaga baru dalam suprastruktur politik lokal. Penelitian hukum normatif ini menggunakan pendekatan yuridis, dan historis, yang penerapannya disesuaikan dengan kebutuhan. Hasil penelitian ini menunjukkan bahwa keputusan kultural Majelis Rakyat Papua tersebut tidak berpengaruh terhadap kebijakan pemerintahan yang mengarah pada perlindungan, pemberdayaan dan keberpihakan terhadap orang asli Papua, karena sebagian materi keputusan yang secara jelas menjadi delegasi undang-undang telah dibuat sebelum keputusan tersebut tanpa melibatkan MRP dalam tahun 2008 karena belum ada instrumen hukum tentang mekanisme kerja antar lembaga suprastruktur pemerintahan daerah sedangkan setelah keputusan MRP pada tahun 2010 dan 2011 tidak dapat menjabarkan regulasi yang telah dibuat dan kebijakan regulasi materi lainnya karena terbentur dengan beberapa agenda politik seperti pemilihan anggota MRP dan pemilihan Gubernur. Hasil penelitian juga menunjukkan bahwa selain pengaturan regulasi, ada sejumlah faktor lain menjadi penyebab tidak efektifnya kinerja kerja pemerintah daerah

This study examines the influence of cultural decision-Papuas People Assembly (MRP) as a material consideration in determining and implementing the regional administration in terms of empowerment, protection and favor of indigenous Papuas in the context of the Act No. 21 of 2001 regarding Special Autonomy for the Papua’s Province as amended by the Act No.35 of 2008 on Special Autonomy for Papua and West Papua Province, aims to examine the extent to which local governments take policy and how the effectiveness of its policies to the authority delegated by referring to the decision. In the construction of theoretical perspective, departing from the concept of state authority in the country, especially the relationship of unity with the position of MRP as a new institution in the local political superstructure. The normative legal research using juridical approaches, and historically, the application tailored to the needs. These results indicate that the decision of the Papuas People Assembly doesn’t affect the government policy which leads to the protection, empowerment and alignments of the indigenous Papuans, because of most the material that is clearly making a process delegation of law before the decision was made without the involvement of MRP in 2008 because there is no legal instrument on the mechanism of inter-institutional superstructure while the local government after the MRP's decision in 2010 and 2011 cannot implement the regulations that have been made and other materials for regulatory policy it also the decision was made in the same time with a political agenda such as the election of members of the MRP and the election of Governor. The results of research also showed that in addition to regulatory arrangements, there are a number of other factors being the cause of the ineffectiveness of the performance of local government.
