PEMBATALAN AKTA JUAL BELI DAN SERTIFIKAT TANAH DI PENGADILAN NEGERI PONOROGO

2012 | Tesis | S2 Magister KenotariatanPenelitian mengenai “Pembatalan Akta Jual Beli dan Sertifikat Tanah di Pengadilan Negeri Ponorogo (Studi Kasus Putusan Pengadilan Nomor 02/Pdt.G/ 2005/PN.PO)†bertujuan untuk mengetahui penyebab pembatalan akta jual beli dan sertifikat tanah oleh Pengadilan Negeri Ponorogo dan untuk mengetahui penyelesaian akibat pembatalan akta jual beli dan sertifikat tanah atas putusan Pengadilan Negeri di Kabupaten Ponorogo, provinsi Jawa Timur. Penelitian ini merupakan jenis penelitian yuridis normatif artinya penelitian dilakukan dengan penelitian kepustakaan untuk memperoleh data sekunder, untuk melengkapi dan menunjang data yang diperoleh dari penelitian kepustakaan juga dilakukan penelitian lapangan. Penelitian dilaksanakan di Kabupaten Ponorogo, Provinsi Jawa Timur. Data yang diperoleh dianalisis secara deskriptif kualitatif dengan memperhatikan fakta-fakta yang ada dalam praktek. Berdasarkan hasil penelitian, dapat diketahui bahwa penyebab pembatalan akta jual beli dan sertifikat tanah di Pengadilan Negeri Ponorogo yaitu adanya cacat hukum dalam akta jual belinya sehingga membawa konsekuensi pada batalnya sertifikat yang terbit atas dasar akta jual beli tersebut, tidak memenuhi ketentuan sebagaimana diatur dalam Pasal 1320 KUHPerdata. Penyelesaian terhadap pembatalan akta jual beli dan sertifikat tanah atas putusan Pengadilan Negeri Ponorogo yaitu dengan dibatalkannya akta jual beli beserta sertifikatnya maka sertifikat akan kembali menjadi atas nama pemilik asal, kemudian berdasarkan amar putusan dinyatakan tanah tersebut adalah harta gono gini maka terhadap tanah tersebut dilakukan pembagian harta warisan yang diikuti proses persertifikatan.
The research about “the cancellation of trade document and land certificate in the District Court of Ponorogo (A Case Study on the court verdict No. 02/Pdt.G/2005/PN.PO) aimed to find out the cause of the cancellation of the trade document and the land certificate by the district court of Ponorogo and to find out the settlement of the cancellation of the trade document and the land certificate toward the court verdict in the district of Ponorogo, the province of East Java. This research was a juridical normative research; which meant that the research was conducted using library study to obtain the secondary data. In order to complete and support the data obtained from the library study, a field study was also conducted. The research took place in the district of Ponorogo, the province of East Java. The data was analyzed in descriptive qualitative method by considering some facts during the practice. Based on the research result, it was known that the cause of the cancellation of the trade document and the land certificate in the District Court of Ponorogo was the defect of the law in the trade document; it brought a consequence toward the cancellation of the certificate which issued based on the related trade document; it did not fulfill the term regulated in Chapter 1320 KUHP. The settlement of the cancellationofthe trade document and the land certificate toward the verdict of the district court of Ponorogo was by cancelling the trade document along with the certificate so that the certificate reverted to the name of the previous owner. Based on the verdict, it was stated that the land was a joint property so that there was a land division toward the inheritance followed by certificating process.
