PERLINDUNGAN HUKUM HAK CIPTA ATAS PROGRAM KOMPUTER MENURUT UNDANG-UNDANG NOMOR 19 TAHUN 2002 TENTANG HAK CIPTA (STUDI KASUS DI KECAMATAN PULAU LAUT UTARA, KABUPATEN KOTABARU)

Tujuan dari penelitian ini adalah untuk mengetahui: (1). bentuk-bentuk pelanggaran terhadap hak cipta atas program komputer di Kecamatan Pulau Laut Utara, Kabupaten Kotabaru, (2). bentuk-bentuk perlindungan hak cipta atas program komputer menurut Undang-Undang Nomor 19 Tahun 2002 tentang Hak Cipta, dan (3). upaya-upaya mencegah pelanggaran hak cipta atas program komputer di Kecamatan Pulau Laut Utara, Kabupaten Kotabaru. Penelitian ini merupakan jenis penelitian yang bersifat normatif empiris, yaitu jenis penelitian yang mengkaji pelaksanaan atau implementasi ketentuan hukum positif dan kontrak, secara faktual pada setiap hukum tertentu yang terjadi dalam masyarakat guna mencapai tujuan yang telah ditentukan. Hasil penelitian menunjukkan bahwa: (1). bentuk-bentuk pelanggaran hak cipta atas program komputer di Kecamatan Pulau Laut Utara, Kabupaten Kotabaru, antara lain; harddisk loading, illegal downloading, softlifting , dan counterfeiting, (2). bentuk-bentuk perlindungan hak cipta atas program komputer menurut Undang-Undang Nomor 19 Tahun 2002, antara lain: perlindungan terhadap program komputer yang dilengkapi dengan kode sumber (literal similarity of coding) dan yang tidak dilengkapi dengan kode sumber (non literal similarity of coding), perlindungan terhadap serangkaian kode yang mengisi instruksi sebuah program komputer, adanya sanksi pidana dan denda serta gugatan secara perdata bagi pihak-pihak yang melakukan pelanggaran, (3). upaya-upaya yang dapat dilakukan untuk mencegah pelanggaran hak cipta atas program komputer di Kecamatan Pulau Laut Utara, Kabupaten Kotabaru, antara lain: menurunkan harga jual produk software asli, melakukan razia terhadap tempattempat yang ditengarai telah melakukan pelanggaran, melakukan sosialisasi tentang bahaya penggunaan software bajakan dan pentingnya menghargai hak cipta orang lain, beralih menggunakan software komputer yang bersifat open source, misalnya Linux.

The purpose of this research is to determine: (1) the forms of violation of the copyright on computer programmes in the North Pulau Laut, Kotabaru Regency, (2) the forms of protection of computer programs copyright according to Act No. 19 of 2002 about copyright, and (3). The efforts to prevent copyright infringement over the computer program in the North Pulau Laut, Kotabaru Regency. This type of research is research that is normative empirical, namely the kind of research that examines the implementation of the provisions of the positive law and contract, factually in every specific case law in the community in order to achieve the goals that have been determined. The results showed that: (1) the forms of copyright infringement for computer programs in the North Pulau Laut, Kotabaru Regency, among others; harddisk loading, illegal downloading, softlifting, and counterfeiting, (2) the forms of protection of computer programs copyright according to Act No. 19 of 2002, among others: protection of a computer program that comes with source code (literal similarity of coding) and which are not equipped with the source code (non-literal similarity of coding), protection against a set of code that fills the instructions a computer program, the existence of criminal sanctions and fines as well as civil lawsuits are for parties that do breach, (3) the efforts that can be done to prevent copyright infringement over the computer program in the North Pulau Laut, Kotabaru Regency, among others: lowering the selling price of the original software product, conducting raids against places the culprits had committed the offence, socialize the dangers of the pirated software usage and the importance of respecting the copyrights of others, switch to using computer software that is open source, such as Linux.
