Penelitian tentang Penyelesaian Sengketa dalam Perjanjian Kerjasama Investasi (Studi Kasus di Perusahaan Perorangan Mitra Karya Mandiri ”Brothers Cellular”), merupakan penelitian yang bersifat yuridis empiris yaitu penelitian yang mengkaji pelaksanaan ketentuan hukum positif secara faktual pada setiap hukum tertentu. Pengkajian tersebut bertujuan untuk memastikan apakah hasil penerapan pada peristiwa hukum in concreto itu sesuai atau tidak dengan ketentuan undang-undang. Penelitian ini lebih menitikberatkan pada penelitian lapangan secara menyeluruh, sistimatis, akurat dan factual mengenai fakta-fakta yang berhubungan dengan penyelesaian sengketa dalam perjanjian kerjasama investasi. Disamping penelitian lapangan juga ditunjang dengan penelitian kepustakaan untuk melengkapi data-data yang diperoleh melalui penelitian lapangan. Penelitian ini bertujuan untuk : 1) mengetahui pelaksanaan Perjanjian Kerjasama Investasi antara Investor dengan Perusahaan Perorangan Mitra Karya Mandiri (Brothers Cellular), 2) mengetahui peyelesaian sengketa dalam hal terjadi wanprestasi oleh Perusahaan Perorangan Mitra Karya Mandiri (Brothers Cellular). Berdasarkan hasil penelitian diketahui : 1) Perjanjian Kerjasama Investasi antara Investor dengan Pemilik Perusahaan Brothers Cellular dibuat dalam bentuk tertulis, yaitu akta di bawah tangan. Perjanjian antara Investor dengan pemilik perusahaan berisi tentang hak dan kewajiban kedua belah pihak. Hak dan kewajiban tersebut tidak sepenuhnya dilaksanakan oleh pihak pemilik perusahaan dengan perkataan lain pemilik perusahaan telah malakukan wanprestasi, 2) penyelesaian sengketa dilakukan melalui Pengadilan oleh salah seorang investor (Penggugat) yang pada akhirnya kasus tersebut di menangkan oleh Penggugat.

Research on Dispute Settlement in Investment Cooperation Agreement (Case Study in Individual Company Mitra Karya Mandiri \"Brothers Cellular\"), an empirical study of the juridical nature of research that examines the implementation of the provisions of positive law in fact on any particular law. The assessment aims to ascertain whether the results of the application on legal events in concreto it or not in accordance with the provisions of law. This study focuses on a thorough field research, systematic, accurate and factual concerning the facts relating to the settlement of disputes in investment cooperation agreement. In addition to field research is also supported by the research literature to complement the data obtained through field research. This study aims to: 1) know the implementation of Investment Cooperation Agreement between the Company's Individual Investor Mitra Karya Mandiri (Brothers Cellular), 2) to the settlement of disputes in the event of default by the Company Individual Mitra Karya Mandiri (Brothers Cellular). Based on the survey results revealed: 1) Investment Cooperation Agreement between the Investor in Careers Companies Cellular Brothers made in written form, the deed under the hand. The agreement between the investor with the owner of the company contains the rights and obligations of both parties. Rights and obligations are not fully implemented by the owner of the company in other words, the owner of the company has possibilities were in default, 2) the settlement of disputes through the Court by one investor (Plaintiffs) who ultimately wins the case mentioned by the plaintiffs.
