Penelitian ini bertujuan untuk menganalisis Tanggung Jawab Sosial (CSR) pada BUMN dengan menggunakan sudut pandang Good Corporate Governance sebagai landasan operasional BUMN di Indonesia. Mengingat kedudukan BUMN yang tunduk kepada ketentuan penerapan GCG seperti yang diatur pada Keputusan Menteri BUMN Nomor : KEP -117/M-MBU/2002 tentang Penerapan Praktek Good Corporate Governance (GCG) pada BUMN dan kedudukan BUMN yang berbentuk Perseroan Terbatas (PT) tunduk pada Undang - Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas dalam hal ini Pasal 74 tentang kewajiban untuk melaksanakan Tanggung Jawab Sosial (CSR). Penelitian dilakukan dengan pendekatan normatif yuridis dan untuk melengkapi dilakukan pendekatan empiris yuridis. Pendekatan normatif yuridis berupa penelitian kepustakaan yang bersumber pada bahan hukum primer, bahan hukum sekunder, bahan hukum tersier. Sedangkan pendekatan empiris yuridis berupa pendekatan yang dilakukan berdasarkan pada penelitian atau kenyataan yang ada di lapangan. Berdasarkan penelitian, diperoleh hasil analisa bahwa pada umumnya CSR telah dikenal terlebih dulu melalui pelaksanaan PKBL pada BUMN. CSR pada BUMN berhubungan erat dengan penerapan prinsip GCG sebagai landasan operasional BUMN, terutama prinsip responsibility karena bersifat stakeholder-driven dibandingkan prinsip lainnya. Dari korelasi keduanya dapat disimpulkan bahwa CSR merupakan salah satu bentuk implementasi prinsip responsibility. PTBA sebagai BUMN ikut menerapkan prinsip GCG secara konsisten dan PTBA juga menerapkan CSR secara berkelanjutan. CSR pada PTBA juga merupakan bagian dari penerapan GCG, hal ini dapat dilihat adanya unsur CSR pada visi dan misi Persero dan terdapat pada pedoman GCG PTBA yaitu dalam Code of Conduct, GCG Code dan laporan tahunan. Adanya implementasi GCG dan CSR ini akan berjalan beriringan memberikan keuntungan dan juga mewujudkan pembangunan berkelanjutan bagi PTBA dan tentunya bagi semua BUMN yang menjalankan keduanya secara konsekuen dan konsisten.

This research aims to analyze the Corporate Social Responsibility of State Owned Firms, using the perspective of Good Corporate Governance as the foundations for operating procedure of State-Owned firm in Indonesia. Because of the State-Owned are subject to the decree of State-Owned Firm Ministry number: KEP-117/M-MBU/2002 related to the implementation of Good Corporate Governance in State-Owned Firm and State-Owned Firm with form of Limited Liability Company that subject to Law Number 40/2007 related to Limited Liability Company. In this case related to article 74 in obligation to do Corporate Social Responsibilities. The study was conducted with normative juridical approach and using the empirical juridical to complementing data. The normative juridical approach consists of library research on primary legal materials, secondary legal materials, and tertiary legal materials. On the other hand, the empirical juridical approach is realized in the research or facts in the field. Based on the research there are a few analysis results; Generally CSR has been Known as PKBL in state company. CSR in the state company is closely related to the implementation of GCG principles as the operational basis of state company, especially the principle of responsibility, because that is lean to stakeholder driven than any other principle. From the correlation of both, can beconcluded that CSR is one form of implementation of the principle of responsibility. PTBA as state company participate consistently apply the principle of Good Corporate Governance and CSR of PTBA also implement an ongoing basis. CSR in PTBA also part of the GCG implementation, this can be seen as there is an element of CSR on the vision and mission company and guidelines contained in GCG PTBA namely the Code of Conduct, Code of the implementation od GCG and CSR go hand in hand it will provide benefits and also realize sustainable development for the PTBA and certainly for all state company that runs both a consistent and consistent.
