PENGARUH PERAN KOMISI PENGAWAS PERSAINGAN USAHA (KPPU) TERHADAP UNDANG-UNDANG NOMOR 5 TAHUN 1999 TENTANG ANTI MONOPOLI DAN PERSAINGAN USAHA TIDAK SEHAT

Untuk terwujudnya iklim usaha yang kondusifmaka sejak 5 Maret 1999 telah disahkan UU Nomor 5 Tahun 1999 tentang Anti Monopoli dan Persaingan Usaha Tidak Sehat yang berlaku efektifmulai 5 September 2000. Tujuan penelitian ini adalah untuk mengetahui peran KPPU terhadap penegakan hukum dan kebijakan persaingan. Kesimpulan yang diperoleh berdasarkan data primer yang dihasilkan dari penelitian lapangan dibandingkan dengan data sekunder yang dihasilkan dari penelitian kepustakaan. Data penelitian setelah dianalisis diperoleh hasil bahwa: 1. Penegakan hukum UU No. 5 Tahun 1999 oleh KPPU telah menjadi salah satu ujung tombak gerakan efisiensi di sektor ekonomi melalui instrumen persaingan usaha. Munculnya reduksi harga/tarif di beberapa sektor industri tidak bisa dilepaskan dari kehadiran persaingan di sektor tersebut. Seiring dengan perkembangan kinerja KPPU, secara keseluruhan KPPU telah menerima sebanyak 265 laporan, tetapi hanya sebanyak 172 laporan yang memiliki materi persaingan usaha. Kasus yang paling dominan adalah yang berkaitan dengan Pasal 22 (persekongkolan tender) sebanyak 104 kasus meliputi sektor usaha instansi pemerintah (Alat Tulis Kantor, Infrastruktur, Kehutanan, Survai, Kesehatan, Pengadaan Alat Kendaraan, Listrik, Mig as, Pertanian, Gula Ilegal, J asa Keamanan dan Teknologi Informasi). 2. Sebagian besar putusan KPPU telah diterima sebagai kekuatan hukum yang mengikat. Meski pelaku usaha tidak menerima secara utuh putusan KPPU yang mengatakan teijadinya pelanggaran terhadap UU Nomor 5 Tahun 1999 tetapi hasil akhir secara keseluruhan, telah terdapat proporsi yang mendorong pada sebuah kesimpulan bahwa putusan KPPU dapat dipatuhi oleh pelaku usaha, bahkan telah mendorong teijadinya perubahan perilaku. 3.Hasil penelitian lapangan menyimpulkan sebagai berikut: a. Tugas KPPU memberikan kontribusi terhadap implementasi UU Nomor 5 Tahun 1999 sebesar 56,10% sedangkan sisanya 43,90% dipengaruhi oleh faktor yang lain selain tugas KPPU. b. Wewenang KPPU memberikan kontribusi terhadap implementasi UU Nomor 5 Tahun 1999 sebesar 54,61% sedangkan sisanya 45,39% dipengaruhi oleh faktor lain selain wewenang KPPU. c. Terdapat hubungan yang positif dan signifikan antara tugas dan wewenang KPPU dengan implementasi UU Nomor 5 Tahun 1999.

The purpose of the research is being to achieve known what the objection role of the Competition Supervisory Commission (KPPU) in law enforcement and prudently of competition. Conclusion found according to primary data gets from field research matched with secondary data gets by researching from library. Analysis of the research data those results are that: 1. Law enforcement of Law No. 5/1999 by KPPU became one of a spearhead efficiency movement in sector of economy through instrument business competition. The prizes reduction appear in some sector industry that unable to release for attending competition in that sector. In prosession with expansion job KPPU in a manner at all KPPU received 265 reported but only 172 reported posses material business competition. The dominant case is that links with section 22 (accessory tender). 104 cases to cover sector busines government authority (office equipment, infrastructure, foresty, survey, healthy, spare part of transportation, electricity, gasoline, agriculture, illegal sugar, security and technology, information service). 2. Maximal verdict of KPPU accepted as strength the law and regulation enforce. Even entrepreneur unacceptable in a manner whole. Verdict of KPPU, said what done with action conflict to the rule and law no. 5/1999. but in the last results all be able proportions to urge on conclusion that KPPU. Verdict properly obey by entrepreneur more over be urged changes character. 3. Field research results on conclusion as: a. Duty KPPU. Gives contribution to implementation the rule and law no. 5/1999. amount 56.10%. And the rest 43.90% influential to other factor another KPPU labor. b. KPPU authority gives contribution to implementation rule and law no. 5/1999, amount 54.61% and the rest 45.39% influential to other factor another KPPU labor. c. To be found positive related and significant between duty and authority KPPU with implementation the rule and law no. 5/1999
