Respon stakeholders terhadap Perda No. 5 Tahun 2007 tentang larangan pelacuran di Kabupaten Bantul

Dalam menindaklanjuti maraknya praktek prostitusi di kawasan Pantai Parangtritis, Pemerintah Kabupaten Bantul telah mengeluarkan Peraturan Daerah No.5 Tahun 2007 tentang Larangan Pelacuran Di Kabupaten Bantul. Diundangkannya Perda tersebut menuai banyak respon dari berbagai stakeholder sehingga mengakibatkan terjadinya kontroversi. Penelitian ini bertujuan untuk mengkaji dan menganalisis tentang respon stakeholder terhadap Perda No.5 Tahun 2007 Tentang Larangan Pelacuran Di Kabupaten Bantul ditinjau dari aspek marginalisasi dan penegakan hak sosial. Metode yang digunakan dalam penelitian ini dikategorikan sebagai penelitian deskriptif kualitatif kemudian dianalisis menggunakan model interaktif. Data diperoleh dari berbagai informan dan informan kunci yang ditentukan secara “purposive sampling”. Hasil penelitian menunjukkan bahwa pelacuran dinilai oleh masyarakat secara luas sebagai pelanggaran norma agama dan norma sosial masyarakat serta tidak sesuai dengan visi dan misi Kabupaten Bantul Projotamansari Sejahtera, Demokratis dan Agamis, sehingga layak untuk diterbitkan Perda yang mengatur larangan pelacuran. Dalam proses perumusan Perda No.5 Tahun 2007, Pemerintah Kabupaten Bantul telah mengikutsertakan atau melibatkan partisipasi masyarakat terutama perempuan seperti tokoh-tokoh agama seperti NU, Muhammadiyah, Alhidayah, perwakilan dari Karang Taruna, dan LSM PKBI termasuk mucikari dan PSK-nya. Dalam implementasi Perda diantaranya pembatasan atau pengurangan hak kebebasan perempuan dan ketakutan mengalami kasus salah tangkap yang merupakan tindakan diskriminasi terhadap perempuan. Pelarangan prostitusi juga mengakibatkan hilangnya mata pencaharian PSK yang memiliki profesi sebagai PSK dan masyarakat disekitar Kawasan Wisata Pantai Selatan. Stakeholder sekunder yang terdiri dari para aktivis perempuan yang tergabung dalam PKBI, LSM yang tergabung dalam Aliansi Yang Menolak Perda Bantul, SPAY, Komnas Perempuan dan UNDP menyatakan bahwa ditinjau dari dari perpektif gender, perda ini merupakan peraturan daerah yang diskriminatif terhadap perempuan terutama pelacur dan menolak diberlakukannya perda ini.

In following up the rampant practice of prostitution in the region Parangtritis, Beach, regency government has issued Local Regulation No.5 of 2007 on the Prohibition of Prostitution in Bantul regency. Enactment of the law does reap a lot of feedback from various stakeholders that resulted in controversy. This study aims to assess and analyze the responses of stakeholders to Regulation No. 5 year 2007 concerning Prohibition of Prostitution In Bantul regency in terms of the enforcement aspect of marginalization and social rights. The method used in this study is categorized as a qualitative descriptive study was then analyzed using an interactive model. Data obtained from various informants and key informants who are determined by "purposive sampling". The results showed that prostitution is widely valued by society as a violation of religious norms and social norms of society and not in accordance with the vision and mission of Bantul Regency Projotamansari Prosperous, Democratic and Religious, so worthy to be published regulations governing the prohibition of prostitution. In the process of formulating the law No.5 of 2007, the Government of Bantul Regency has to include or involve community participation especially of women as religious leaders such as NU, Muhammadiyah, Alhidayah, representatives of Youth, and NGOs PKBI including pimps and prostitutes. In the implementation of the law include restrictions or reducing the rights of freedom of women and fear of false arrest case that an act of discrimination against women. Prohibition of prostitution also leads to loss of livelihoods of commercial sex workers who have a profession as a prostitute and the community around the tourist area of southern beach. Secondary stakeholders comprising women activists belonging to the PKBI, NGOs who are members of the Alliance of All Refuse Regulation of Bantul, SPAY, National Commission for Women and UNDP said that viewed from the perspective of gender, this is the applicable local regulations that discriminate against women, especially prostitutes and refuse enactment of this regulation.
