Perkembangan pengaturan atas fungsi pengawasan Dewan Perwakilan Rakyat Republik Indonesia

DPR memiliki tiga fungsi yaitu legislasi, anggaran, dan pengawasan. Ketiga fungsi tersebut dijalankan berdasarkan UUD dan UU serta Peraturan Tatib DPR. Penelitian ini bertujuan untuk mengetahui perkembangan pengaturan fungsi pengawasan DPR beserta politik hukum yang melandasi pembentukan dan pelaksanaannya. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif eksploratif dengan menekankan pada aspek sejarah hukum dan perbandingan hukum, dalam hal ini perbandingan antara peraturan perundangundangan yang mengatur fungsi pengawasan DPR, baik yang berlaku saat ini maupun yang pernah berlaku. Berdasarkan hasil penelitian diketahui bahwa pengaturan fungsi pengawasan DPR telah mengalami perubahan sejak bergulirnya Orde Baru hingga sekarang. Perubahan substansial mengenai fungsi pengawasan tersebut terjadi sebanyak empat kali yaitu pada tahun 1969, 1999, 2003, dan 2009 dengan diterbitkannya UU Susduk Lembaga Perwakilan. Dalam keempat UU tersebut diatur fungsi DPR untuk mengadakan pengawasan terhadap pemerintah atas pelaksanaan undang-undang, pelaksanaan APBN serta kebijaksanaan Pemerintah. Dalam perkembangan setiap kali perubahan/pergantian, UU tersebut menambahkan tugas, wewenang serta hak dan kewajiban tambahan kepada DPR untuk menguatkan fungsi pengawasan. Perkembangan tersebut memiliki tren politik hukum yang mengarah pada penguatan fungsi pengawasan DPR yaitu dengan menambahkan intrumen pengawasan berupa hak sub poena, pengurangan hak prerogatif Presiden, penambahan alat kelengkapan DPR, dan penguatan hak individual anggota DPR dengan mereduksi fungsi Fraksi DPR. Politik hukum pengaturan fungsi pengawasan DPR yang mengarah pada penguatan tersebut terjadi secara signifikan pasca amandemen UUD 1945 dengan semangat zaman untuk menciptakan checks and balances diantara eksekutif dan legislatif

Parliament has three functions consists of legislation, budgets, and oversight. These three functions are executed based on the Constitution and the Act and the Rules of Procedure of Parliament. This study aims to determine the development of Parliament oversight arrangements and legal politics underlying the formation and implementation. This research is a normative law research that use a descriptive explorative method with emphasis on aspects of legal history and comparative law, in this case the comparison between the legislation governing of Parliament oversight function, both current and ever valid. Based on the research, note that Parliament oversight regulation have been amended since the New Order goes by until now. Substantial changes of oversight functions occurs as much as four times that in 1969, 1999, 2003, and 2009 with the publication of the act on the organization and the position of Representative Institutions. In each four act, regulated the function of Parliament to conduct oversight of the government over the implementation of acts, budget implementation and government policy. In the development of every time a change / changes, the bill adds duties, authority and the rights and also additional obligations to the Parliament to strengthen its oversight function. These development have a legal political trends that led to the strengthening of the Parliament oversight function by adding the right instruments in the form of oversight, such as sub poena rights, a reduction in the prerogative of the President, additional completeness body of Parliament, and strengthening the rights of individual members of Parliament by reducing the function of parliament faction. The legal political regulation of Parliament oversight functions that lead to a significant strengthening occurred after the amendment of the 1945 Constitution with the spirit of the time to create checks and balances between the executive and legislative branches.
