Makmur Papan Permata tentang pembangunan peremajaan Pasar Pusat Sukaramai Pekanbaru bertujuan untuk mengetahui kesesuaian perjanjian kerjasama pembangunan peremajaan Pasar Pusat Sukaramai Pekanbaru antara Pemerintah Kota Pekanbaru dengan PT. Makmur Papan Permata, dengan prosedural dan substansial peraturan perundang-undagan yang mendasarinya dan untuk mengetahui akibat hukum perjanjian kerjasama itu terhadap perlindungan hukum bagi pihak ketiga yang mempunyai hak guna bangunan (HGB), hak pakai (HP), dan hak sewa (HS) sebelumnya di atas hak pengelolaan (HPL) Pemerintah Kota Pekanbaru. Penelitian ini sifatnya penelitian yuridis normatif dan yuridis empiris (sosiolegal research), dalam penelitian ini menggunakan dua jenis data yaitu data primer dan sekunder. Untuk mencari data primer dilakukan melalui penelitian lapangan (empiris) dengan cara wawancara dan data sekunder dilakukan melalui kepustakaan dengan studi dokumen. Setelah data terkumpul dianalisis secara kualitatif, kemudian disajikan dalam sebuah laporan bersifat diskriptif. Hasil penelitian ini, pertama perjanjian yang dilakukan belum sesuai dengan peraturan perundang-undangan yang mendasarinya karena sebelum pelaksanaan atau pada pelaksanaan atau setelah pelaksanaan perjanjian, hak pimilik-pemilik tanah sebagai objek dari perjanjian belum dilakukan musyawarah seharusnya sebelum pembangunannya dilakukan musyawarah dengan para pedagang terhadap objek perjanjian pembangunan tersebut, kedua perlindungan terhadap pihak ketiga tidak mendapatkan perlindungan hukum secara maksimal karena pemegang-pemegang hak atas tanah kehilangan haknya untuk menempati atau ganti rugi terhadap tanah dan bangunan yang dimilikinya, walaupun melalui gugatan perdata Nomor 42/PDT/G/ 2001/PN.PBR tanggal 8 Juli 2001 mereka dimenangkan, yaitu menyatakan pembongkaran secara paksa yang dilakukan tergugat merupakan perbuatan melawan hukum, tidak mempunyai kekuatan hukum terhadap keputusan yang dikeluarkan tergugat sepanjang menyangkut hak-hak pihak ketiga, serta menghukum tergugat membayar ganti kerugian kepada pihak ketiga, akan tetapi putusan tersebut belum bisa dilaksanakan.
The research on the join contract between the Pekanbaru Municipality government and PT. Makmur Papan Permata regarding the renovation of Sukaramai Central Market - Pekanbaru aimed to identify the compliance of the joint contract of the renovation of Sukamai Center Market Pekanbaru between Pekanbaru Municipality Government and PT. Makmur Papan Permata, with the procedures and underlying substantial legal regulations, and also to identify the legal consequences of the contract on legal protection for the previous third parties having HGB (right to own building), HP (right to use), and HS (right to rent) on the land under the HPL (right to manage) of management of Pekanbaru Municipality Government. This was a juridical normative and socio-legal research. Two types of data, i.e. primary and secondary data were used in this research. The primary data were collected through the use of field (empirical) study by conducting interviews, and secondary data were obtained through literature study by carrying out documentary study. After collected, data were qualitatively analyzed, and they were presented in a descriptive report. The results of this study showed that, firstly, contract entered had not complied with the underlying legal regulations because before or during or after the implementation of the contract, no agreement had been conducted concerning the rights of landowners as the contract object. An agreement with traders concerning the object of the contract should be conducted before the renovation was started. Secondly, the third party was not provided with maximum legal protection due to the lost rights of landowners to occupy, or no compensation on the land and buildings owned had been provided, although through the lawsuit number 42/PDT/G/2001/PN.PBR dated 8 July 2001, the landowners won the case; it was stated that the forcibly demolition that the defendant conducted was against the law, not having legal power against the decisions issued by the defendant as far as concern with third parties’ rights, and it was ordered that the defendant should pay compensation to third parties.
