Mekanisme harmonisasi dalam pembentukan peraturan daerah di Provinsi Daerah Istimewa Yogyakarta

Tujuan penelitian ini adalah untuk mengetahui implementasi mekanisme harmonisasi dalam pembentukan peraturan daerah di Provinsi Daerah Istimewa Yogyakarta, untuk mengetahui hambatan apa yang dihadapi dalam proses harmonisasi dalam pembentukan peraturan daerah serta untuk mengetahui upaya yang dilakukan untuk mengatasi hambatan tersebut. Penelitian yang dilakukan adalah penelitian yang bersifat normatif dan empiris yaitu suatu tipe penelitian yang menggabungkan antara penelitian hukum normatif dengan penelitian hukum empiris. Tipe penelitian hukum normatif dilaksanakan dengan menelaah data sekunder yang diperoleh dari bahan hukum primer seperti berbagai peraturan perundang- undangan yang terkait dengan obyek penelitian, bahan hukum sekunder berupa literatur (buku) dan makalah tentang otonomi daerah maupun ilmu perundang-undangan serta bahan hukum tersier yang berupa kamus Bahasa Indonesia. Tipe penelitian hukum empiris dilaksanakan melalui kegiatan observasi terhadap faktafakta hukum yang relevan dengan materi penelitian guna mendapatkan data primer yang diperoleh dari wawancara terhadap para responden. Dari hasil penelitian dan pembahasan dapat diketahui bahwa mekanisme harmonisasi dalam pembentukan peraturan daerah pada saat mulai diterapkannya kebijakan otonomi daerah belum dilaksanakan dengan baik sehingga di Kabupaten Bantul, Kabupaten Kulon Progo dan Kabupaten Sleman ditemukan adanya beberapa peraturan daerah yang dibatalkan oleh pemerintah. Hambatan implementasi harmonisasi dalam pembentukan peraturan daerah pada awalnya disebabkan belum adanya peraturan yang mengatur mengenai harmonisasi terhadap rancangan peraturan daerah serta tidak adanya sanksi apabila tidak mentaati mekanisme tersebut. Dalam mengatasi permasalahan tersebut, belum ada upaya nyata oleh Bagian Hukum Pemerintah Kabupaten Bantul, Kabupaten Kulon Progo dan Kabupaten Sleman. Oleh karena itu, Pemerintah Provinsi Daerah Istimewa Yogyakarta harus aktif melakukan koordinasi dan supervisi dalam pembentukan produk hukum daerah dengan pemerintah kabupaten/kota.

This research was conducted to know how good was the implementation of the mechanism of harmonization in formulating the local regulations in the provincial of special region of Yogyakarta, the problems in harmonization processing of local regulation, and their solutions. The conducted research was normative and empiric. It was a combination between the normative and empirical researches of law. The normative researches of law was conducted by evaluating secondary data that were acquired from primary legal material such as various legislative regulations related to the object of research, secondary legal material like the literatures (books) and papers about local autonomy and legislative sciences, and tertiary legal material like Indonesian dictionary. The empirical research of law was conducted to by doing observational activities of realities of law that rele vant to the research matters to get primary data from some interviews with the respondents. It can be concluded from the research that the harmonization mechanism in the formulating process of local regulation at the beginning of regional autonomy implementation has not been done very well, therefore it was found out that there were some regional regulations that were being terminated by government in the Bantul County, Kulon Progo County and Sleman County. The obstacles faced in the implementation of harmonization in the formulating process of local regulation at first was caused by the absence of regulation needed to govern the harmonization of the bill for local regulation, as well as there was not any sanction being enforced in the event of failure of compliance to the aforementioned mechanism. In connection to that problem, there hasn’t been any realistic effort made by the legal division of the government of Bantul County, Kulon Progo County and Sleman County to try to solve it. Therefore it is best for the government of the special Region of Yogyakarta Province to be more proactive in coordinating and supervising the government in county and city level in the drafting of regional legal regulations.
