Penggunaan telepon seluler telah menjadi hal yang umum bagi sebagian besar masyarakat Indonesia. Garansi merupakan salah satu hal yang sangat penting dalam praktek jual beli telepon seluler di Kota Yogyakarta. Penelitian ini adalah penelitian yuridis empiris. Sumber data meliputi data primer yang penulis peroleh dari pihak yang bersangkutan dan data sekunder dengan mempelajari bahan kepustakaan yang berkait dengan masalah dalam penelitian ini. Metode pengumpulan data primer dilakukan dengan teknik wawancara terarah dengan pihak-pihak yang terkait dengan pelaksanaan garansi pada praktek jual beli telepon seluler di Kota Yogyakarta dan pengumpulan data sekunder dilakukan dengan melihat data dan literatur yang terkait dengan pelaksanaan garansi pada praktek jual beli telepon seluler di Kota Yogyakarta. Metode analisis menggunakan analisis kualitatif dimana data disusun secara sistematis dengan pola induktif dan tidak menutup kemungkinan digunakan pola deduktif dan komparatif. Hasil penelitian diperoleh kesimpulan bahwa terdapat dua jenis garansi dalam pelaksanaan jual beli telepon seluler di Kota Yogyakarta yaitu garansi resmi dan garansi toko, dan terdapat dampak-dampak baik positif maupun negatif dari pelaksanaan garansi tersebut, dan peran Notaris sebagai Pejabat pembuat akta juga diperlukan untuk melindungi hak-hak dari para pelaku usaha yang terdapat di dalam proses tersebut.

The cellular phonesusage had becomea general matter for most Indonesian people. The guarantee was one of the most important matters in the cellular phones trade in Yogyakarta. This research is an empirical judicial research. The data sources includes primary data which author obtained from related subjects and secondary data obtained by studying the substance literature which is related to the problems of this research. The collecting method of primary data is using directional interview technique with related sides by the implementation of the guarantee in the practice of the trade of cellular phone on Yogyakarta and the collecting of the secondary data doing by seeing the books and literature which is related by the implementation of the guarantee in the practice of the trade of cellular phone on Yogyakarta. The analysis method used qualitative analysis where the data is composed systematically by using inductive pattern but it’salso possibleto usea deductive and comparative pattern. The Results of this research had concludedwith two sorts of guarantee in the implementation of cellular phones trade in Yogyakarta, they are the official guarantee and the distributor's guarantee, which also has positive and negative impacts from the implementation of each guarantee, and the role of the Notary as the Official of the manufacturer of the certificate also was needed to protect the rights from the perpetrators of efforts that were received in this process.
