Pelaksanaan layanan rakyat untuk sertifikasi tanah (Larasita) di Kabupaten Bantul

2010 | Tesis | S2 Magister KenotariatanPenelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan LARASITA di Kabupaten Bantul mulai dari tahap persiapan, sumber biaya, pelaksanaan LARASITA, persepsi masyarakat dan PPAT, hambatan yang dihadapi dan cara menyelesaikan hambatan tersebut. Metode penelitian yang dipergunakan adalah pendekatan yuridis empiris, dan kemudian dianalisis secara deskriptif-kualitatif sehingga mendapatkan penjelasan yang akurat tentang pelaksanaan LARASITA di Kabupaten Bantul. Hasil penelitian menunjukan bahwa Pertama, Persiapan yang dilakukan oleh Kantor Pertanahan Kabupaten Bantul sebelum melaksanakan LARASITA, meliputi: (1) pembentukan Tim LARASITA; (2) penentuan jenis pelayanan LARASITA; (3) pemilihan desa lokasi sasaran LARASITA; (4) pembuatan jadwal kunjungan dan pengumumannya; (5) pembuatan rencana teknis sosialisasi; (6) pengadaan sarana dan prasarana pendukun; Kedua, Sumber biaya LARASITA di Kabupaten Bantul berasal dari anggaran rutin BPN RI dan Pemohon; Ketiga, Pelaksanaan LARASITA di Kabupeten Bantul tidak sepenuhnya menerapkan Perkaban No. 18 tahun 2009. Keempat, Persepsi masyarakat terhadap pelaksanaan LARASITA di Kabupaten Bantul adalah kurang merespon dengan LARASITA walaupun umumnya mempunyai persepsi baik (positif). Kelima, Persepsi PPAT terhadap LARASITA adalah adalah kurang merepon walaupun mempunyai persepsi baik (positif) terhadap LARASITA. Kelima, LARASITA di Kabupaten Bantul dilaksanakan sesuai peraturan perundang-undangan yang berlaku. Keenam, Dalam praktek terjadi beberapa hambatan, antara lain: (1) belum siapnya sumber daya manusia Tim LARASITA, (2) Jadwal kunjungan yang tidak disampaikan ke masyarakat; (3) Kurang optimalnya sosialisasi LARASITA; (4) Peralatan komputer LARASITA sering mengalami gangguan menangkap sinyal karena keadaan geografis (5) Masih adanya keluhan masyarakat karena mahalnya biaya pensertifikatan tanah melalui LARASITA karena ada biaya-biaya tambahan yang ditanggung masyarakat dan masih ada praktek percaloan. Cara mengatasi kendalakendala tersebut adalah (1) Mengadakan pelatihan bagi Tim LARASITA, (2) menciptakan koordinasi yang baik dengan Pihak Kantor Desa, (3) Jika peralatan kehilangan signal maka berkas dibawa pulang dan didaftarkan secara on-line di Kantor Pertanahan, (4) Kantor Pertanahan Kabupaten Bantul perlu menghimbau masyarakat untuk mendaftarkan sendiri langsung melalui LARASITA, tanpa dikuasakan.
The aim of this research is to get a better understanding on how the implementation of LARASITA in Bantul District from the preparation, source of fund, implementation of LARASITA, perspective of people’s and PPAT (Public Notary), threats to be drawn against and the way to settle aforementioned threats. The method exercised is juridical empirical approach and afterward the research is analyzed in descriptive-qualitative manner in order to achieve the accurate explanation regarding the implementation of LARASITA in Bantul District. The outcome of this research shows: First, the preparation Bantul District Land Office before implementing LARASITA, comprising: (1) the establishment of LARASITA team; (2) the determination of LARASITA service; (3) preference of LARASITA village location; (4) the making of visit schedule and the announcement; (5) the making of socialization technical plan; (6) procurement of facility and supporting infrastructure; Second, Source of fund of LARASITA in Bantul District is not is not merely derived from the routine budget of National Land Office Republic of Indonesia (BPN) and the applicant; Third, the implementation of LARASITA in Bantul District is not completely apply Perkaban No. 18 Year 2009. Fourth, People’s perspective upon LARASITA in Bantul District has less respond although commonly it has a good (positive) perspective upon LARASITA. Fifth, PPAT perspective upon LARASITA in Bantul District has less respond although commonly it has a good (positive) perspective upon LARASITA, Sixth, In practice, there are some threats, namely: (1) Unprepared human resources of LARASITA team, (2) The visiting schedule that is not informed to society; (3) Less socialization of LARASITA; (4) LARASITA computer device often encounters problem in getting signals because of the geographical condition (5) there are complaints as of the high cost of land certification through LARASITA since there are additional fees subjected to people and a brokerage practice that is still happen. The way to handle those threads are (1) Making training plan for LARASITA team, (2) Creates good coordination with the Village Office, (3) In case the computer device has less signals consequently the file must be collected afterward and registered online in Land Office, (4) Bantul District Land Office required to recommend people to register land certification by themselves, without any delegation.
