Aspek yuridis hubungan kerja tenaga pelaksana verifikasi dalam program jaminan kesehatan bagi masyarakat

Tenaga pelaksana verifikasi (selanjutnya disingkat TPV) Program Jaminan Kesehatan Bagi Masyarakat (Jamkesmas) memegang peranan penting dalam rutinitas kesehari-harian pelaksanaan Jamkesmas yaitu memeriksa kebenaran dokumen tagihan pembiayaan pelayanan kesehatan yang ditanggung oleh pemerintah terhadap masyarakat miskin dan tak mampu serta kelompok pekerja formal dan non formal. Meskipun TPV tersebut melaksanakan tugas dari pemerintah (hubungan dinas publik), namun hubungan kerja tenaga pelaksana verifikasi dengan pemerintah tersebut belumlah sebagaimana layaknya hubungan kerja seperti pegawai negeri sipil. Yang menjadi pokok permasalahan dalam penelitian ini yaitu: (i) bagaimana status hubungan kerja antara TPV dan pemerintah ? dan (ii) bagaimana pelaksanaan perlindungan hukum bagi mereka ? Penelitian ini dimaksudkan untuk mengetahui secara teoritis dari aspek yuridis kejelasan status pekerja tenaga pelaksana verifikasi tersebut dan untuk mendapatkan gambaran variabel-variabel yang diperlukan dalam memberikan perlindungan hukum bagi mereka. Penelitian ini bersifat normatif empiris. Sebagai narasumber, ditentukan terbatas pada para pejabat struktural di lingkungan Kementerian Kesehatan, Kementerian Tenaga Kerja dan Transmigrasi, dan Badan Kepegawaian Negara yang memiliki tugas fungsi di bidang ketenagakerjaan dan/atau kepegawaian. Hasil penelitian menunjukan bahwa terdapat dualisme legalitas formal hubungan kerja TPV dengan pemerintah, yaitu disatu sisi diterbitkan SK pengangkatan dan di sisi lain adanya kontrak kerja. Jadi terdapat ketidakpastian hukum dalam hal ini sehingga sudah tentu berakibat dalam hal pelaksanaan perlindungan hukum bagi TPV yang menjadi sempit dan terbatas. Untuk itu, demi keadilan hukum bagi TPV, maka perlu diperbaiki norma-norma dalam SK pengangkatan khususnya dengan menyatakan dasar hukum yang jelas yang sesuai dengan Hukum Kepegawaian dan bukan Hukum Perburuhan. Dan bila tidak memungkinkan TPV diangkat sebagai PTT atau PNS, maka sebaiknya dibuatkan kontrak yang bernafas Hukum Kepegawaian dan bukan Hukum Perburuhan. Verificator of the Community Health Insurance Program (Jamkesmas) plays an important role in daily routines-execution of Jamkesmas i.e. to verify health care's billing documents that the financing which is borne by the government towards the poor and unable as well as formal and non-formal workers' group. Although the Verificator is carrying out the duties of government (public service relationship), but a working relationship with government are not yet verified as appropriate working relationship as a civil servant. This research tries to observe as follows : (i) how the status of the working relationship between the Verificator and the government ? ; and (ii) how the implementation of legal protection for them? This research was conducted to understand theoretical aspects of juridical clarity worker status of the Verificator and to get description of the variables required in providing legal protection for them. This research is based on juridical-empirical-normative. As resources of data are namely structural officials within the Ministry of Health, Ministry of Labor and Transmigration, and State Personnel Board has a task function in labor, and I or employment. This research produced some findings. First, there is a formal legal dualism of the Verificator's working relationship with the government, which issued by the decree of appointment on one side and on the other side by contract. Second, based on this fact will inflict that there is legal uncertainty in this regard and so that the implementation of legal protection for the Verificator which became narrow and limited. Therefore, in order to make legal justice for the sake of the Verificator, it is necessary to repair the norms in the appointment decree specifically stating a clear legal basis in accordance with the Civil Service Law and not by the Labour Law. And if there is still no opportunity for the Verificator to become as PTI or civil servants, then it "should be" made a contract, so the contract should be based on Civil Service Law and not by the Labour Law.
