Penelitian mengenai Perlindungan Hukum Terhadap Investor Dalam Transaksi Forex Online Melalui Introducing Brokerage (IB) dilakukan untuk mengetahui pelaksanaan perjanjian pembagian keuntungan dalam transaksi Forex Online melalui Introducing Brokerage (IB), untuk mengetahui perlindungan hukum terhadap investor dalam transaksi Forex Online melalui Introducing Brokerage (IB) dan untuk mengetahui bagaimana Notaris mengakomodasi kebutuhan para pelaku transakasi Forex Online, baik dari sisi Investor maupun Broker, terkait dengan fungsi dan kapasitasnya sebagai pejabat umum. Penelitian ini merupakan penelitian yuridis normatif dengan metode deskriptif kualitatif, yaitu menggambarkan situasi dan kondisi yang diteliti dihubungkan dengan isi peraturan yang berlaku yang berhubungan dengan judul penelitian. Data penelitian ini menekankan pada sumber data sekunder sebagai data utama yang diperoleh melalui penelitian kepustakaan. Data penelitian setelah dianalisis dengan menggunakan metode deskriptif kualitatif, diperoleh hasil: 1. Introducing brokerage (IB) dalam transaksi forex tidak memberikan keuntungan kepada investor karena investor memperoleh keuntungan (atau kerugian) dari transaksi yang dilakukannya sendiri secara online. Introducing Broker hanya sebagai wakil dari pialang berjangka yang berkantor pusat di luar negeri dan mempermudah investor apabila akan menarik dananya karena adanya keuntungan yang didapatkan atau menyetorkan tambahan deposit apabila mengalami kerugian. Introducing Broker tidak menarik sejumlah margin tertentu. Introducing Broker memperoleh keuntungan dari selisih nilai tukar mata uang yang diambil/disetor melalui fasilitas money changer yang dimiliknya. 2. Perlindungan hukum terhadap investor dalam transaksi forex online melalui introducing brokerage (IB) diberikan oleh Pasal 49 sampai dengan Pasal 56 UU No.32 Tahun 1997, khususnya bagi investor pada perusahaan pialang dalam negeri, untuk penyaluran amanat ke perusahaan pialang luar negeri atau diluar jam perdagangan bursa (overthe- counter-market), perlindungan hukumnya tunduk pada perjanjian yang telah disepakati. 3. Seorang Notaris dalam transaksi forex online kapasitasnya sebagai pejabat umum khususnya dalam pembuatan akta otentik fungsinya tidak tergantikan. Notaris dapat berfungsi memfasilitasi para pihak dalam transaksi perniagaan elektronis (e-commerce), tinggal bagaimana kehadiran notaris dalam transaksi tersebut dimungkinkan secara teknologi dan dirumuskan konsekuensi hukumnya.

The research about Law Protection toward investor in forex online transaction through Introducing Brokerage is to know the implementation of share profit agreement in forex online transaction through Introducing Brokerage (IB), Law Protection toward investor in forex online transaction through Introducing Brokerage and to know notary accommodate the need of transaction forex online subjects, from the investor and broker side, concerned with function and capability as a public position. This research is a normative juridical research with qualitative descriptive method, which describes the situation and conditions associated with the content examined regulations related to the research title. The data of this study emphasizes the secondary data sources as the primary data obtained through the research literature. From research data after analyzed using qualitative descriptive methods, obtained results: 1. Introducing brokerage (IB) in foreign exchange transactions do not provide benefits to investors because the investors make profits (or losses) from transactions that do their own online. Introducing Brokers only as a representative of the futures broker headquartered abroad and make it easier to attract investors if the funds because of the benefits obtained or additional deposit if the deposit losses. Introducing Brokers do not attract a certain margin. Introducing Brokers earn profit from the difference in exchange rates are taken/paid through a money changer facility that owned by Introducing Brokers. 2. Law protection toward investors in online forex transactions through a brokerage Introducing (IB) is given by Article 49 to Article 56 of UU No.32 Tahun 1997, especially for investors at brokerage firms in the country, for mandate distribution to the brokerage firm abroad or outside trading hours (over-the-counter-market), the protection of law subject to the agreement agreed upon. 3. A notary as his capacity as public officials in online forex transactions, especially in the production of official document is irreplaceable function. Notary may function to facilitate the parties in electronic commerce transactions (e-commerce), now how a notary to presence in the transaction is made possible by technology and formulated its legal consequences.
