Faktor-faktor yang menyebabkan terbitnya sertifikat ganda sehubungan dengan profesi PPAT di Kabupaten Klaten

Penelitian mengenai Faktor-Faktor Yang Mendorong Terbitnya Sertipikat Ganda Sehubungan Dengan Profesi PPAT di Kabupaten Klaten bertujuan untuk mengetahui faktor-faktor yang dapat mendorong terbitnya sertipikat ganda, baik pada pemohon atau pejabat terkait dalam penerbitan sertipikat dan bagaimana cara mengatasi. Penelitian ini merupakan hukum empiris karena mengutamakan penelitian lapangan yang dilakukan dengan wawancara terbuka dengan responden yang dipilih secara langsung terlibat dalam proses penerbitan sertipikat ganda, didorong dengan bahan pustaka sebagai data sekunder dan metode yang digunakan adalah kualitatif. Hasil penelitian bahwa faktor-faktor ini adalah sebagai berikut :1. pada pemohon:kepentingan ekonomi pemohon, sisi kelemahan peraturan perundang-undangan, situasi dilapangan yang mendukung, 2.pada kepala desa: faktor kepentingan ekonomi kepala desa yang bersangkutan, kurang tertibnya administrasi di kantor desa, pengumuman yang tidak efektif karena kurang tersosialisasikan dan tidak adanya peta dasar untuk desa tersebut, 3. pada kantor pertanahan karena tidak adanya peta dasar sebagai acuan, pelepasan hak yang tidak dicatatkan pada buku tanah, pengumuman yang pro forma saja, adanya petugas yang nakal. Cara mengatasi masalah adalah sebagai berikut : 1. pengumuman data yuridis dan data fisik lebih disosialisasikan dengan cara mengumumkan dalam pertemuan rutin bulanan di desa,2. pemerintah hendaknya mengusahakan memberikan penyuluhan kepada Kepala Desa beserta aparatnya dan juga kepada para petugas kantor pertanahan mengenai pentingnya administrasi dan kearsipan, 3.petugas loket penerimaan permohonan pendaftaran tanah di secara sporadik dan secara sistematis harus bekerja sama dan saling memberikan informasi tentang tanah yang dimohonkan ,4. PPAT tidak membuatkan akta pemindahan hak atas tanah yang belum pernah didaftarkan dan menunggu sampai permohonan sertipikat pertama selesai diproses.

Research on the factors that encourage the rising double certificate in the district Klaten , and how it aims to identify factors that can be factors that encourage rising double certificate, either the applicant or the officers involved in the publication certificate and how to overcome. This research is legal because the empirical field research conducted with interviews and selected respondents directly involved in the process of issuing certificate double, encouraged with the library materials assecondary document and methods used are qualitative. Results of research that this factors are follows: 1.the applicant: the interests of private economic aplicant, the influence of encouragement from the other party and the weakness of the invitation and the situation in the support, 2.the head of the village: the economic interests of the village concerned, less legal order administration in the village office, the announcement is not effective because less socialization and the absence of a basic map for the village, 3. the land office: map does not have any basis as a reference, which does not release the rights recorded on the books of land, lack of announcement conducted pro forma only, executive officer of the unprincipled. How the issue is as follows: 1. the document and juridical data fiction more socialization manner announced in the monthly routine meeting in the village, 2. government should strive to provide counseling to the head of the village and its officials and also to the office staff about the importance of land administration and archival matters, reception counters 3.officer request registration of land in conversion or confirmation the sporadic and the systematic system must work together and give each other information about land requested, 4. The land document officer maker officer does not make the transfer of rights over land that has not been registered and waiting until the first certificate request has been processed.
