Proses pelaksanaan Peraturan Daerah Nomor 20 Tahun 1998 tentang Izin Mendirikan Bangunan di Kabupaten Ende

Penelitian ini bertujuan untuk mendeskripsikan Proses Pelaksanaan Peraturan Daerah Nomor 20 Tahun 1998 tentang IMB dan menemukan hambatan serta upaya yang dilakukan dalam proses pelayanan IMB di Kabupaten Ende. Penelitian ini bersifat normatif empiris. Bentuk data dalam penelitian ini adalah data pustaka dan data lapangan. Data data pustaka diperoleh dengan cara inventarisasi bahan-bahan hukum, sedangkan data lapangan diperoleh melalui wawancara terbuka dengan stakeholders dan narasumber. Hasil penelitian ini menunjukkan bahwa proses pelaksanaan Peraturan Daerah Nomor 20 Tahun 1998 tentang IMB dalam rangka mewujudkan penataan bangunan di Kabupaten Ende masih sangat sulit dilaksanakan. Pola pelayanan IMB yang tidak kompatibel dengan ketentuan Peraturan Daerah Nomor 20 Tahun 1998, menyebabkan prosedur pelayanan IMB sangat birokratis, persyaratan, biaya dan waktu penyelesaian IMB tidak efektif dan efisien. Hambatan yang dihadapi yakni, eksistensi dan esensi Peraturan Daerah Nomor 20 Tahun 1998 tentang IMB berpijak pada peraturan perundang-undangan yang sudah tidak berlaku lagi pada masa sekarang, pola pelayanan sangat birokratis, rendahnya tingkat kesadaran masyarakat, lemahnya pengawasan dan penerapan sanksi hukum yang tidak konsisten. Langkah yang ditempuh untuk mengatasi hambatan dalam pelaksanaan Peraturan Daerah Nomor 20 Tahun 1998, yakni: menyesuaikan pelaksanaan IMB dengan peraturan yang baru, menerapkan One Stop Service (OSS), meningkatkan sosialisasi tentang IMB, melakukan koordinasi antar instansi dan revitalisasi fungsi PPNS dalam melakukan pengawasan dan menerapkan sanksi hukum secara konsisten.

This research aimed to describe the Process Implementation of The Local Regulation Number 20 of 1998 about the Building Registration (Ijin Mendirikan Bangunan - IMB) and to identify the obstruction and the effort that had been conducted to process implementation the Building Registration at Ende District. This research was a normative empirical study. The data in this research was library data and field data. The data had been obtained by collecting the law materials, but field study by open interviewing to the stakeholders and references. The result pointed that the process implementation of Local Regulation Number 20 of 1998 about the Building Registration at Ende District was very difficult to be conducted. The service of Building Registration that had not compatible with the Local Regulation Number 20 of 1998, had caused the servicing procedure of Building Registration is very complicated. The requirement to get the registration was not effective and efficient so it has consumed many of costs and times. The obstruction that the existence and essence of Local Regulation Number 20 of 1998 still base on the act which was out of date, the public service was very bureaucratic, less of the people awareness, the weakness of supervision and the inconsistency of law enforcement. Some efforts that should be conducted to overcome the obstruction of implementation of the Local Regulation Number 20 of 1998, as follow: adjust process implementation of the Building Registration with the news regulation, increasing the socialization of Building Registration, performing coordination across the agencies and revitalization of PPNS function in conducting the supervision, apply the One Stop Service (OSS) and law enforcement by performing a consistent sanction.
