Proses penerapan hukuman disiplin terhadap pegawai negeri sipil di Kabupaten Ende

Penelitian ini bertujuan Deskriptif yaitu untuk memperoleh gambaran proses penerapan hukuman disiplin Pegawai Negeri Sipil di Kabupaten Ende menurut PP No,30 Tahun 1980, tujuan Kreatif untuk mengetahui kendala hukum yang dihadapi dalam penerapan hukuman disiplin Pegawai Negeri Sipil di Kabupaten Ende dan tujuan Inovatif yaitu merumuskan langkah-langkah yang harus dilakukan dalam proses penerapan hukuman disiplin Pegawai Negeri Sipil di Kabupaten Ende. Penelitian ini merupakan Penelitian hukum Normatif yang terdiri dari penelitian kepustakaan dan penelitian lapangan. Alat yang digunakan dalam pengumpulan data primer adalah wawancara dengan nara sumber dan responden, sedangkan data sekunder diperoleh dari studi kepustakaan. Hasil Penelitian menunjukan bahwa : 1. Proses Penerapan Hukuman Disiplin Pegawai Negeri Sipil di Kabupaten Ende belum dilaksanakan secara efektif . 2. Kendala hukum yang menghambat Penerapan Hukuman Disiplin Pegawai Negeri Sipil di Kabupaten Ende adalah kendala sistem peraturan perundangundangan yang berkaitan dengan penerapan penjatuhan hukuman disiplin, dan lemahnya pengawasan yang dilakukan oleh atasan mengenai disiplin Pegawai, kendala ketaatan asas yaitu asas kejelasan rumusan terkait dengan peraturan disiplin PNS, dan berkaitan dengan pelaksanaan penjatuhan hukuman disiplin, kendala tingkat harmonisasi peraturan perundang-undangan terkait belum ada pengaturan yang tegas mengenai pemberian jenis hukuman disiplin terhadap jenis pelanggaran secara rinci dan jelas di lingkup pemerintah Kabupaten Ende. 3. Langkah hukum yang dapat dilakukan untuk mengatur dengan jelas kewenangan penjatuhan hukuman disiplin pegawai, mengefektifkan pengawasan oleh atasan langsung dan merevisi Peraturan Disiplin PNS dengan memasukan unsur pengawasan, merevisi Peraturan Disiplin PNS terkait dengan jenis penjatuhan hukuman disiplin pegawai, membuat pedoman pemberian jenis hukuman disiplin tertentu terhadap jenis pelanggaran secara rinci dan jelas di lingkup Pemerintah Kabupten Ende.

Firstly, this research aimed to get the description of discipline punishment implementation at the Ende District Officials according the PP No. 30 of 1980; secondly, the creative purpose that was to know the law obstruction that has been faced in implementing the punishment discipline of Ende District Officials; and thirdly, the innovative purpose that was to arrange some steps that should be done in order to implement the discipline punishment. This research was Normative Law Research by using library and field researches. The tool which had been used in the primary data collection was the interview to the respondents and some of references, while the secondary data had been gotten from the library study. The result of the research pointed that: l. The implementation of Discipline Punishment of Ende District Officials had not be conducted effectively. 2. The law obstruction that restricted the implementing of Discipline Punishment of Ende Disctrict Officials was the obstruction of Act Regulating System in relation with the implementation of discipline punishment penalty, and the weakness of the supervision which have been conducted by the tap management about the Officials discipline. The principle obedient obstruction that is the concept clarification principle related to the regulation of Officials discipline, and related to the implementation of discipline punishment penalty, the obstruction of harmonization in act regulating related to the boldly regulating about the kind of the punishment to the some trespasses at Ende District have not be implemented details and clearly. 3. The law effort that could be conducted to regulate the officials discipline punishment penalty authority clearly and the effectively supervision should be conducted by top management directly. The government should revised the Discipline Regulation of Officials by installing the supervising action and revised the Discipline Regulation of Officials in relating with the kind of the officials discipline punishment penalty, and making a guideline to the any kind discipline punishment according to the kind of trespasses detail and clearly in Ende District govemnent context.
