Pelaksanaan perjanjian kredit pada lembaga pembiayaan konsumen PT Armada Finance Magelang untuk pembelian kendaraan bermotor

Armada Finance Magelang atas wanprestasinya debitur, dan juga untuk mengetahui bentuk pertanggung-jawaban PT. Armada Finance Magelang kepada PT. Bank Mandiri (Persero) Tbk. selaku penyandang dana, atas wanprestasinya debitur. Penelitian ini adalah penelitian hukum empiris, yaitu penelitian berdasarkan pelaksanaan dalam upaya memperoleh data primer didahului dengan penelitian penelitian kepustakaan untuk memperoleh data sekunder. Penelitian dilaksanakan di PT. Armada Finance Magelang, dan keseluruhan data yang diperoleh dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa penyebab debitur wanprestasi adalah kondisi ekonomi, bencana alam, huru-hara, kecelakaan lalulintas, analisis kredit tidak benar, musnahnya benda jaminan, karakter buruk karyawan, usaha mengalami kerugian, karakter buruk debitur, debitur meninggal dunia, pengalihan barang jaminan, dan nasabah hanya pinjam /atas nama. Terhadap debitur yang wanpretasi, PT. Armada Finance melakukan tindakan berupa pemberian surat peringatan, rescheduling, penarikan benda jaminan, reposisi, eksekusi benda jaminan. Bentuk pertanggungjawaban PT. Armada Finance Magelang kepada PT. Bank Mandiri (Persero) Tbk. atas wanprestasinya debitur adalah dengan cara membeli fasilitas pembiayaan yang bermasalah dari pihak Bank dan menggantikan kedudukan Bank sebagai kreditur dengan konsekwensi membayar lunas kepada Bank atas keseluruhan kewajiban pihak debitur
The present research aims to comprehend the causes of debtors’ failures to repay PT Armada Finance Magelang, the measures taken by this financing institution to deal with these failures, as well as the manner in which it satisfies its responsibility toward PT Bank Mandiri (persero) Tbk. as its financier. This is an empirical juridical research, one that is based on actual attempts to obtain primary data to be supplemented with research of normative law, library research intended to obtain secondary data. The research was conducted in PT Armada Finance Magelang, and all the data obtained here would be analyzed qualitatively. Research results indicate that the causes of debtors’ failures are economic conditions, riot and such as disaster, traffic accident, bankruptcy on the part of the debtors, incorrect credit analyses, inappropriate credit agreements, bad behaviors on the part of the creditor’s agents, business losses, bad behaviors of debtors’, death of debtor, misappropriation and lost of collaterals, or the fact that the real debtor is actually someone else who has borrowed his credentials. In responding to failures, PT Armada Finance delivers notices, conducts rescheduling, reclaims collaterals, repossesses the merchandise, and executes collaterals. To satisfy its responsibility to PT Bank Mandiri (Persero) Tbk. for such failures, PT Armada Finance implements to buying the finance facilities from bank – namely, to replace the position of the bank as creditor, thus repaying to the bank the full amount that the debtor has owed.
