Praktik pengawasan majelis pengawas wilayah terhadap notaris di Provinsi Maluku

Penelitian mengenai Praktik Pengawasan Majelis Pengawas Wilayah terhadap Notaris di Provinsi Maluku bertujuan untuk mengetahui praktik pengawasan terhadap Notaris oleh Majelis Pengawas Wilayah Provinsi Maluku dan kendala yang dihadapi oleh Majelis Pengawas Wilayah Provinsi Maluku dalam menjalankan tugasnya serta upaya yang dilakukan oleh Majelis Pengawas Wilayah Provinsi Maluku untuk mengatasi kendala-kendala tersebut. Penelitian ini merupakan penelitian yuridis empiris. Subyek dari penelitian ini adalah mereka yang terkait langsung yaitu Majelis Pengawas Wilayah Provinsi Maluku dan Notaris. Data yang dipergunakan dalam penelitian ini adalah data primer yang diperoleh melalui wawancara tanpa mengesampingkan data sekunder yang diperoleh melalui studi kepustakaan. Keseluruhan data yang diperoleh kemudian dianalisis secara kualitatif dengan menggunakan metode berpikir deduktif. Hasil penelitian ini menunjukkan bahwa pengawasan terhadap Notaris di Provinsi Maluku dilakukan sebagaimana yang diatur dalam Undang-undang, namun pada praktiknya pengawasan oleh Majelis Pengawas Wilayah yang berkedudukan di ibukota provinsi masih sulit untuk dilakukan terutama terhadap Notaris di kabupaten, hal ini karena secara geografis ibukota Provinsi Maluku dan kabupatennya dipisahkan oleh laut. Kondisi geografis Provinsi Maluku dan minimnya sarana transportasi menyebabkan pada saat melakukan pemeriksaan Protokol Notaris, disamping menyesuaikan jadwal pemeriksaan dengan jadwal anggota Majelis Pengawas Wilayah, juga memperhatikan kondisi perairan dan jadwal sarana transportasi yang digunakan ke kabupaten, untuk dapat mengetahui kondisi Notaris di kabupaten maka Majelis Pengawas Wilayah melakukan dialog tidak resmi dengan Notaris pada saat Notaris berada di Ambon. Kendala yang dihadapi dalam melakukan pengawasan yaitu anggaran yang belum memadai, kurangnya sarana dan prasarana, masih sulit menyesuaikan jadwal antara anggota Majelis Pengawas Wilayah pada saat akan dilakukan pemeriksaan, serta kondisi geografis Provinsi Maluku. Upaya yang dilakukan untuk mengatasi kendala tersebut yaitu menyesuaikan jadwal pelaksanaan pemeriksaan dengan jadwal kapal, melakukan musyawarah untuk menunjuk anggota yang lain apabila salah satu anggota berhalangan hadir, untuk pemberitahuan kepada Notaris di kabupaten terkait pemeriksaan Protokol Notaris dikirimkan 1 (satu) bulan sebelumnya dan pemeriksaan terhadap Protokol Notaris dilakukan pada bulan Mei sampai dengan Agustus karena kondisi perairan Maluku sedang tenang.

This research concerned on the Supervision Practice of Regional Supervisory Committee towards the Notary in Maluku Province, by purpose was to know the practice of supervision towards the Notary conducted by Regional Supervisory Committee of Maluku Province in conducting his duties and the barriers faced by Regional Supervisory Committee in doing its duty and also the efforts conducted by the Regional Supervisory Committee of Maluku Province to overcome those barriers. This research was juridical empirical research. The subjects of this research were these who directly related to the Regional Supervisory Committee of Maluku Province and Notary. The data used in this research was primary data of which was gained through interview without neglecting to secondary data of which was gained through literary study. The entire data gained was then analyzed qualitatively by using method of deductive reasoning method. The result of this research shows that the supervision towards Notary in Maluku Province is conducted as has been regulated in laws, however in practice, supervisory by Regional Supervisory Committee of which has position in capital city is still difficult to conduct, in particularly to the Notary in regency. It is caused by geographically, capital city of Maluku Province and its regency is separated by sea. The geographical condition of Maluku Province and the minimum of transportation medium caused the case during conducting supervision towards Notary Protocol, in addition to adjust the investigation schedule towards the schedule of the members of Regional Supervisory Committee, as well to consider the condition of watery and schedule of transportation medium used to the regency, in order to know the condition of Notary in regency, thus the Regional Supervisory Committee conduct informal dialogue along with Notary during the Notary is in Ambon. The barriers faced in conducting supervision is inappropriate budget, the lack of medium and prerequisites, the difficulties in adjusting the schedule among the Regional Supervisory Committee during pre implementation of supervision, and the geographical condition of Maluku Province. The efforts conducted to overcome those barriers are adjusting the schedule of supervision implementation to the shipment schedule, conduct the concession to select the other members in the case of one of members does not perform, to alert announcement to the Notary relating to Notary Protocol to the Notary who has settlement in regency, is sent 1 (one) month before, and investigation to Notary Protocol is conducted between May to August on the ground of watery condition of Maluku is calm.
