Penataan kelembagaan pengelolaan hutan di Kabupaten Sorong Selatan, Papua Barat

Penelitian berjudul penataan kelembagaan pengelolaan hutan di Sorong Selatan, Papua Barat bertujuan mendapatkan informasi tentang pengelolaan hutan menurut perspektif pemerintah dan adat Papua, dan Mendapatkan rumusan pegelolaan hutan yang tepat melalui penataan kelembagaan yang sesuai dengan sistem nilai Papua yang dapat diimplementasikan Sorong Selatan. Penelitian ini menggunakan metode kualitatif terkait dengan kebijakan pengelolaan hutan di kabupaten Sorong Selatan. Data penelitian diambil dari UU 41 tahun 1999 tentang kehutanan, UU No 21 tahun 2001 tentang otonomi khusus Papua, informasi dari Pemerintah Daerah Sorong Selatan dan informasi yang berasal dari dewan adat suku Maybrat, suku Tehit dan suku Imekko. Hasil penelitian menunjukan bahwa property right/ hak kepimilikan, batas yuridikasi dan aturan representatif pengelolaan hutan oleh pemerintah pusat yang tertuang di dalam UU 41 tahun 1999 tentang kehutanan bersifat top down dan mengikat. Property right / hak kepimilikan, batas yuridikasi dan aturan representatif pengelolaan hutan menurut UU No 21 Tahun 2001 tentang otonomi khusus Papua belum berjalan karena belum ada rancangan peraturan daerah khusus (raperdasus) dan rancagan peraturan daerah provinsi raperdasi yang menjadi acuan. Property right / hak kepimilikan, batas yuridikasi dan aturan representatif pengelolaan hutan pemerintah daerah Sorong Selatan mengikuti UU No 41 Tahun 1999. Property right masyarakat adalah harta bersama dan harta milik, batas yuridiksi diakui sebagai otoritas kelompok adat dan aturan representatif yang bersifat global tidak diakui. Property right, batas yuridikasi dan aturan representatif antara pemerintah dengan masyarakat adat bertolak belakang. Kelembagaan Dewan Musyawarah Kehutanan Daerah (DMKD) dibentuk untuk meminimalisir dan menghindari konflik

This study with the title of The Institutional Reform of Forest Management in South Sorong Regency, West Papua, aims at exploring information about forest management in according to the Papua government and custom perspectives, and finding out an appropriate formulation of forest management through institutional reform in accordance with the value systems of Papua communities, which can be implemented in South Sorong Regency. It used a qualitative method of exploring policies on forest management in South Sorong Regency. Data of the study were collected from Law No. 41/1999 on Forestry, Law No. 21/2001 on Special Autonomy of Papua, data from Local Government of South Sorong Regency, and information from customary boards of Maybrat, Tehit, and Imekko tribes. The result of the study indicates that property rights, jurisdiction boundary, and representative regulation on forest management owned by central government contained in Law No. 41/1999 on Forestry were top-down and tightly bounding in nature. The property rights, jurisdiction boundary and representative regulation on forest management according to Law No. 21/2001 on Special Autonomy of Papua could not be implemented, because there was no special draft of local regulation as references at a regent or provincial level. Property rights, jurisdiction boundary, and representative regulation on forest management applied by Local Government of South Sorong Regency was in accordance with Law No. 41/1999. The property rights of community were collective assets and properties, jurisdiction boundary was recognized as in the hand of authority for customary group, and representative regulation on forest management with global level was not recognized. Property rights, jurisdiction boundary, and representative regula-tion were contradictory between government and customary communities. The institution of the Consultation Assembly of Local Forestry was established for minimizing and avoiding conflicts.
