Perbandingan perlindungan hukum pekerja kebersihan antara pekerja kontrak outsourcing dengan pekerja kontrak bukan outsourcing :: Studi kasus di Rumah Sakit Umum Daerah Kabupaten Semarang

2009 | Tesis | S2 Magister HukumPenelitian ini dimaksudkan untuk mengetahui alasan Rumah Sakit Umum Daerah (RSUD) Ambarawa Kabupaten Semarang melakukan outsourcing, dan mengetahui perbandingan perlindungan upah dan jaminan kesehatan bagi pekerja kebersihan pekerja kontrak outsourcing CV Riska dan pekerja kontrak bukan outsourcing RSUD Ambarawa yang dilaksanakan oleh masing-masing perusahaan. Untuk mencapai tujuan tersebut dilakukan penelitian hukum empiris dan analisa data menggunakan pendekatan kualitatif dengan metode deskriptif dan komparasi. Dalam penelitian ini penulis menggambarkan dan menjelaskan tentang alasan perusahaan melakukan outsourcing dan membandingkan perlindungan upah dan jaminan kesehatan bagi pekerja kebersihan dari kontrak outsourcing CV Riska dan pekerja kebersihan kontrak bukan outsourcing RSUD Ambarawa yang dilakukan oleh masing-masing perusahaan. Tehnik pengumpulan data menggunakan wawancara dengan narasumber dan para pekerja kebersihan dari kontrak outsourcing CV Riska dan pekerja kontrak bukan outsourcing RSUD Ambarawa dan pengamatan terhadap lokasi kerja di RSUD Ambarawa dan para pekerja kebersihan dari kontrak outsourcing dan pekerja kebersihan dari kontrak bukan outsourcing. Hasil penelitian ini adalah sebagai berikut pertama, alasan RSUD Ambarawa melakukan outsourcing karena kekurangan pekerja kebersihan dan meningkatkan pelayanan kebersihan. Kedua, perlindungan upah pekerja kebersihan dari kontrak outsourcing oleh CV Riska dan pekerja kebersihan dari kontrak bukan outsourcing oleh RSUD Ambarawa adalah pekerja kebersihan sama-sama diberi upah pada waktu pekerja kebersihan tidak masuk kerja karena sakit atau keperluan lain dengan mendapat izin, tunjangan hari raya dan seragam baju kaos. Perbedaannya adalah: a) pekerja kebersihan kontrak outsourcing oleh CV Riska diberi upah lebih rendah dari Upah Minimum Kabupaten (UMK) Semarang, sedangkan pekerja kebersihan dari kontrak bukan outsourcing oleh RSUD Ambarawa diberi upah sama dengan UMK Semarang, tetapi pekerja kebersihan harian lepas diberi upah lebih rendah dari UMK Semarang; b) pekerja kebersihan dari kontrak outsourcing tidak berhak mendapat upah lembur dari CV Riska, sedangkan pekerja kebersihan dari kontrak bukan outsourcing berhak mendapat upah lembur dari RSUD Ambarawa; c) pekerja kebersihan dari kontrak outsourcing tidak berhak mendapat bonus, sedangkan pekerja kebersihan dari kontrak bukan outsourcing berhak mendapat bonus. Ketiga, perlindungan jaminan kesehatan bagi pekerja kebersihan dari kontrak outsourcing oleh CV Riska dan pekerja kebersihan dari kontrak bukan outsourcing oleh RSUD Ambarawa adalah pekerja kebersihan sama-sama diberlakukan jam kerja selama 7 jam dan istirahat minimal 30 menit serta diberi istirahat mingguan 1 hari. Perbedaannya adalah: a) pekerja kebersihan dari kontrak outsourcing tidak disediakan masker dan sepatu boot untuk bekerja, sedangkan pekerja kebersihan dari kontrak bukan outsourcing disediakan masker dan sepatu boot untuk bekerja; b) pekerja kebersihan dari kontrak outsourcing tidak mendapat pemeriksaan, pencegahan dan pengobatan penyakit dari CV Riska, sedangkan pekerja kebersihan dari kontrak bukan outsourcing mendapat pemeriksaan, pencegahan dan pengobatan penyakit dari RSUD Ambarawa; c) pekerja kebersihan dari kontrak outsourcing tidak mendapat Jamsostek, sedangkan pekerja kebersihan dari kontrak bukan outsourcing mendapat Jamsostek dari PT Jamsostek (Persero).
The purpose of this research is to know about the reasons of Ambarawa Regional Public Hospital (RSUD Ambarawa) in Semarang Regency doing outsourcing, knowing about comparison of wages protection and healthy insurance for the cleaning service as outsourcing contract laborers on CV Riska and for the non outsourcing contract laborers on RSUD Ambarawa that is held by each companies. Reaching that purpose is done by empirical law research and data analysis using qualitative approach, descriptive and comparative methods. In this research the writer describe and explain the company reasons doing outsourcing and compare the wages protection and health insurance for the cleaning service as outsourcing contract laborers on CV Riska and for the non outsourcing contract laborers on RSUD Ambarawa that is held by each companies. Technique of data collection by using interview with the sourcher and cleaning services as outsourcing contract laborers on CV Riska and for the non outsourcing contract laborers on RSUD Ambarawa and doing supervision on work place that is on RSUD Ambarawa and cleaning service as outsourcing contract laborers on CV Riska and cleaning service for the non outsourcing contract laborers. The following statements are the result of research. Firstly,the reason why RSUD Ambarawa doing outsourcing are because they are less in laborers as cleaning service and develop cleaning service. Secondly, protection wages for cleaning services as outsourcing contract laborers on CV Riska and cleaning service for the non outsourcing contract laborers on RSUD Ambarawa are given the same things in giving wages when the were absent because sick or another important things with permission, wages for the feast days financial and also for tshirts uniform. The differences are: a) cleaning service outsourcing contract laborers on CV Riska are given the principal wages is lower than standard minimum wages in Semarang Regency, however cleaning service non outsourcing contract laborers on RSUD Ambarawa are given the same wages with standard minimum wages in Semarang Regency, but cleaning service as overtime workers are given lower wages from UMK Semarang; b) cleaning service outsourcing contract laborers on CV Riska have non a right having wages overtime workers, however cleaning service for non outsourcing contract laborers on RSUD Ambarawa have that right on it; c) cleaning service outsourcing contract laborers on CV Riska have not extra wages, however cleaning service for non outsourcing contract laborers on RSUD Ambarawa have right on it. Thirdly, protection health insurance for cleaning service as outsourcing contract laborers on CV Riska and cleaning service non outsourcing contract laborers on RSUD Ambarawa are they have been applied for time working along 7 hours and resting time for 30 minuts in a day, and also given a resting time weekly for a day. The differences are: a) cleaning service outsourcing contract laborers on CV Riska are not given mask and boot for works, however cleaning service non outsourcing contract laborers on RSUD Ambarawa are given mask dan boot; b) cleaning service outsourcing contract laborers are not got the service, devending and treatment for the desease from CV Riska, however cleaning service non outsourcing contract laborers get it from RSUD Ambarawa; c) cleaning service outsourcing contract laborers do not have a health guarantee for laborers (Jamsostek), however cleaning service non outsourcing contract laborers have a health guarantee for laborers from PT Jamsostek.
