Fungsi dan tanggung jawab Majelis Pengawas Notaris Daerah Kota Makassar terhadap akta notaris yang telah pensiun

Penelitian ini dimaksudkan untuk menjawab permasalahan : (1) fungsi dan tanggung jawab Majelis Pengawas Daerah terhadap Akta yang pernah dibuat oleh Notaris yang telah memasuki masa pensiun; (2) bentuk perlindungan hukum bagi Akta Notaris yang telah memasuki masa pensiun. Penelitian ini bersifat normatif empiris, yaitu dengan cara melakukan penelitian kepustakaan untuk memperoleh data sekunder dan penelitian lapangan untuk memperoleh data primer. Penelitian ini dilakukan di kota Makassar dengan menggunakan metode non random sampling, dengan pengambilan sampel berdasarkan purposive sampling, yaitu 5 (lima) orang Notaris pemegang protokol Notaris sebagai responden dan nara sumber terdiri dari 3 (tiga) orang anggota Majelis Pengawas Daerah kota Makassar. Data yang diperoleh diolah secara kualitatif kemudian disajikan secara deskriptif. Berdasarkan hasil penelitian maka dapat dikemukakan bahwa (1) Pelaksanaan fungsi pengawasan dan tanggung jawab Majelis Pengawas Daerah terhadap akta yang pernah dibuat oleh Notaris yang telah memasuki masa pensiun tidak lagi optimal. Hal ini disebabkan karena MPD hanya berwenang untuk memeriksa akta yang pernah dibuat oleh Notaris yang telah memasuki masa pensiun yang berada dalam penyimpanan Notaris pemegang protokol. MPD tidak berwenang lagi untuk memanggil/memeriksa Notaris yang telah pensiun untuk memberi keterangan dan jawaban dalam rapat/sidang mengenai akta yang pernah dibuatnya; (2) Bentuk perlindungan hukum bagi akta Notaris yang telah memasuki masa pensiun pada aspek preventif diwujudkan dengan memahami sistem hukum positif, sehingga MPD dapat bekerja secara professional dan fungsional dalam menjalankan kewenangannya, yaitu pembinaan dan pengawasan terhadap Notaris dan akta Notaris , sedangkan pada aspek represif diwujudkan melalui peran MPD dalam melaksanakan pemeriksaan dalam rapat/sidang dan memberikan putusan/jawaban atas permohonan penyidik terhadap pengambilan minuta akta dan fotokopi minuta akta guna kepentingan proses peradilan dengan berdasar pada hasil rapat/sidang yang dilaksanakan oleh MPD.

This research is normative empirical, that is the way to do literature research to obtain secondary data and field research to obtain primary data. Research was conducted in the city of Makassar using non-random sampling, with sampling based on sampling purposively, that is five (5) the holder of the Notary Public Notary protocol as respondents and sources consist of three (3) members of the Assembly's regional city of Makassar. The data obtained are processed and then presented a qualitative descriptive. Based on the results of research so that it can be (1) The function and responsibility of the regional Assembly of teaching license was made by the Notary Public who has entered the period of retirement is no longer optimal. This is because MPD is only authorized to review of teaching license was made by the Notary Public who has been entering the pension which is in the storage holder Notary protocol. MPD does not have the authority to call/check the Notary Public who has a pension to provide information and answers in the meeting/hearing about the ever made it of teaching license, (2) The form of legal protection for the Notary of teaching license that has been entered on the pension aspects of preventive realized with the legal system to understand the positive , so that the MPD can work in a professional and functional authority in the run, the guidance and supervision of the Notary Public of teaching license and, while on the repressive aspects of the role of MPD realized through conduct in the examination in the meeting/hearing and the decision to give/answers to the investigators on the application of teaching license minuta and photocopying of teaching license to the interests of justice to the process based on the results of the meeting/hearing held by the MPD.
