Perlindungan hukum terhadap karyawan notaris yang bertindak sebagai saksi dalam pembuatan akta

Penelitian ini dimaksudkan untuk menjawab permasalahan : (1) bentuk dan pelaksanaan perlindungan hukum bagi karyawan Notaris yang bertindak sebagai saksi dalam pembuatan akta; (2) upaya yang dilakukan oleh Notaris dalam memberikan perlindungan terhadap karyawannya yang bertindak sebagai saksi dalam pembuatan akta. Penelitian ini bersifat yuridis empiris, yaitu dengan cara melakukan penelitian lapangan untuk memperoleh data primer dan penelitian kepustakaan untuk memperoleh data sekunder. Penelitian ini dilakukan di kota Makassar dengan pengambilan sampel berdasarkan purposive sampling. Cara pengumpulan data dilakukan dengan studi dokumen dan juga teknik wawancara yaitu dengan melakukan wawancara terhadap 10 (sepuluh) orang notaris, 3 (tiga) orang anggota MPD yang mewakili masing-masing unsur yaitu dari unsur pemerintah, unsur notaris dan unsur akademisi, 3 (tiga) orang penyidik kepolisian Resort Makassar Timur yang pernah menyidik saksi akta yang berasal dari karyawan notaris serta 6 (enam) orang karyawan notaris. Berdasarkan hasil penelitian maka dapat dikemukakan bahwa (1) bentuk perlindungan hukum terhadap karyawan notaris yang bertindak sebagai saksi dalam pembuatan akta diberikan sesuai dengan ketentuan dalam UUPSK dan KUHAP sedangkan dalam UUJN sendiri tidak ada perlindungan secara spesifik terhadap saksi dalam pembuatan akta notaris sedangkan pelaksanaan perlindungan hukum terhadap saksi akta yang berasal dari karyawan notaris belum optimal karena keberadaan saksi hanyalah sebagai objek semata untuk mengungkap adanya unsur melawan hukum yang dilakukan oleh notaris tempat mereka bekerja; (2) upaya yang dilakukan oleh notaris dalam memberikan perlindungan terhadap karyawannya yang bertindak sebagai saksi akta dilaksanakan melalui upaya preventif yaitu upaya pencegahan yang dilaksanakan sesuai dengan ketentuan UUJN dan tindakan lain yang sifatnya dapat meminimalkan resiko di kemudian hari sepanjang tidak bertentangan dengan peraturan perundangundangan serta upaya represif yaitu upaya yang dilakukan apabila terjadi permasalahan terhadap akta yang telah dibuatnya utamanya dalam menjamin hakhak karyawannya dari proses penyidikan pihak kepolisian.

This research is intended to address the problems: (1) the form of legal protection for employees of the Notary act as a witness in the creation of teaching license, (2) the efforts undertaken by the Notary in providing protection to the employees who act as witnesses in the making of teaching license. This research is a juridical empirical, that is the way to do field research to obtain primary data and literature research to obtain secondary data.. Research was conducted in the city of Makassar with sampling based on sampling purposively. How data collection is done with the study document and interview technique that is also conducted interviews of the 10 (ten) the notary, three (3) members of the MPD, which represents each element of the elements of the government, the government and elements of academics, three (3 ) the police investigators East Makassar Resort had investigate witness of teaching license that comes from government employees and 6 (six) employees notary. Based on the research result so we can explain that (1) the form of legal protection against government employees who act as witnesses in the making of teaching license granted in accordance with the provisions in UUPSK and KUHAP UUJN while in itself does not have specific protection against the witness in the making and implementation of teaching license notary protection law of teaching license to the witness that comes from government employees have not been optimal because of the existence of the witness only as an object only to reveal the existence of elements against the law done by the government for which they work, (2) the efforts undertaken by the government in providing protection to employees who act as witnesses of teaching license held through preventive efforts that prevention efforts undertaken in accordance with the provisions UUJN and other actions that can minimize the risks are in the future as long as it does not contradict the legislation that is repressive and efforts made the effort when the problems occur on they made of teaching license that has been primarily in ensuring the rights rights-employees of the police investigation process.
