Kedudukan surat pelepasan tanah adat dalam proses penerbitan sertipikat pada Kantor Pertanahan Kota Sorong

Penelitian mengenai kedudukan surat pelepasan tanah adat dalam proses penerbitan sertipikat bertujuan untuk mengetahui sejauh mana pentingnya surat pelepasan tanah adat dalam suatu proses penerbitan sertipikat dan untuk mengetahui faktor-faktor apa yang menjadi penunjang sekaligus penghambat dalam proses penerbitan sertipikat kaitannya dengan surat pelepasan tanah adat. Penelitian ini bersifat sosiologis yuridis yang didukung oleh penelitian normatif empiris. Penentuan responden menggunakan teknik purpossive sampling. Data diperoleh dengan cara teknik wawancara secara semi terstruktur kemudian diklasifikasikan menjadi data kualitatif, dan dianalisis menggunakan metode berfikir deduktif, selanjutnya diuraikan dan dijabarkan secara deskriptif. Hasil penelitian ini menunjukkan, pertama : fungsi surat pelepasan tanah adat terhadap proses penerbitan sertipikat pada Kantor Pertanahan Kota Sorong adalah sebagai pemenuhan data Yuridis yang merupakan salah satu syarat dalam proses penerbitan sertipikat. Pada Lembaga Masyarakat Adat sendiri surat pelepasan tanah adat ini berfungsi sebagai pemberian kepastian hukum kepada pihak lain yang ingin memiliki tanah adat, selain itu penerbitan surat pelepasan tanah adat adalah bertujuan untuk mencegah pihak pemilik tanah adat untuk melepaskan tanah adat lebih dari satu kali. Kedua, Akibat hukum yang timbul apabila tidak diterbitkannya surat pelepasan tanah adat adalah tidak dapat diterbitkannya sertipikat oleh pihak Kantor Pertanahan Kota Sorong karena tidak lengkapnya data yuridis sebagai kelengkapan administrasi dalam proses penerbitan sertipikat.

This research is about the legal status of the adat land letter of release in the process of publishing the certificate. This research is intended to know the importance of the adat land letter of release in the process of publishing the certificate and the supporting or obstructing factors in the process of publishing the certificate related to the adat land letter of release. This research is juridical sociological study which supported by empirical normative research. Purposive sampling method is done to choose the respondent. The data is collected by semi-structured interview method then classified to be qualitatively data. The data is analyzed by deductive method and descriptively processed. The results of research show that: first, the function of the adat land letter of release in the process of publishing the certificate is a fulfillment of juridical data which is one of the requirements in the process of publishing the certificate. Meanwhile, the function of the adat society institution is to give the legal certainty to the people who want to own adat land and to prevent the adat land owner to release the adat land that he or she was owned more than once; second, if the adat land letter of release is not published, the land certificate will not published by Land Office of Sorong, because in the process of publishing the certificate, the adat land letter of release is needed as juridical data.
