Pelaksanaan persertifikatan tanah Laba Pura di Kota Denpasar

Tujuan dari penelitian ini adalah untuk mengetahui mengapa terjadi perubahan status tanah laba pura dari milik pura menjadi milik pribadi, Apakah proyek Pensertipikatan Tanah Laba Pura dapat menjadi solusi bagi penertiban pemilikan tanah laba pura tersebut. Penelitian Pelaksanaan Pensertipikatan Tanah Laba pura Di Kota Denpasar merupakan penelitian yang bersifat yuridis empiris yaitu penelitian yang mempergunakan data primer yaitu data yang diperoleh langsung dari masyarakat, yang didukung dengan data sekunder yaitu peraturan-peraturan hukum yang mengatur tentang pertanahan. Lokasi yang dipilih adalah Kota Denpasar terdiri dari 4 Kecamatan yaitu Kecamatan Denpasar Utara, Kecamatan Denpasar Timur, Kecamatan Denpasar Selatan dan Kecamatan Denpasar Barat, yang masing-masing memiliki Desa Pakraman. Badan Hukum yang dapat Mempuyai Hak Milik Atas Tanah ditunjuk dengan PP Nomor 38 Tahun 1963. Khusus penunjukan Pura sebagai Badan Hukum Keagamaan yang dapat mempunyai hak milik atas tanah ditunjuk dengan SK Mendagri No.SK.556/DJA/1986. Terjadinya perubahan status Tanah Laba pura dari milik pura menjadi tanah milik pribadi karena adanya pergeseran nilai kepercayaan yang diberikan kepada seseorang untuk mengelola tanah Laba pura dan terjadinya pergeseran cara pandang nilai sakral dan nilai agama terhadap tanah Laba pura menjadi nilai ekonomi serta belum bersertipikatnya tanah-tanah laba pura tersebut. Pada dasarnya hak milik dapat terjadi secara original dan derivatif yang mengandung unsur, ciri dan sifat masing-masing. Secara original hak milik terjadi berdasarkan hukum adat, sedangkan secara derivatif ditentukan oleh peraturan perundang-undangan. Pensertipikatan tanah laba pura atas nama pura yang bersangkutan menjadi solusi penertiban dan memberikan penegasan hak serta perlindungan hukum tehadap kepemilikannya. Desa Pakraman sebagai lembaga adat adalah penjaga kelestarian harta kekayaan Desa, salah satunya adalah Tanah Laba pura, sehingga kota yang berwawasan budaya dapat diwujudkan.

The study aims at investigating why the change of laba pura land status into personal land title takes place and whether the certification project of laba pura land may be the solution in bringing law and order to the ownership of the laba pura land. It is conducted in Denpasar City and represents an empirical and juridical one that uses the primary data directly collected from people supported by secondary data, which are the laws of land affairs. Its location is Denpasar City consisting of 4 subdistricts, which are North Denpasar, East Denpasar, South Denpasar and West Denpasar with their respective Pakraman villages. The legal body may be granted the land title is determined on Government Regulation Number 38 of 1963. The special determination of Pura as a religious legal body that may be granted the land title is based on the Decree of the Minister of Internal Affairs No.SK.556/DJA/1986. The change of the Laba Pura land status from the Pura ownership to personal ownership because of the trust value given to someone to manage the land and the change in the way how people recognize religious and sacred value of the land to economic value and the lack of a legal certificate of the land. Basically, the land title may be granted on original and derivative basis with its respective elements, characteristics and nature. On original basis the land title is granted following the existing custom law, while on the derivative basis it is granted following the existing positive law. The certification of the Laba Pura land in the name of the Pura concerned becomes the solution in bringing law and order to the ownership of the land and confirms the land title and legal protection of the bearer of the land title. Pakraman village as custom institution represents the party responsible for the conservation of village possessions, including the Laba Pura land that the idea of culture-based city may be materialized.
