Pelaksanaan pendaftaran akta jual beli atas tanah pertanian yang letaknya bersebelahan kecamatan dengan domisili pemohon pada Kantor Pertanahan Kabupaten Sleman

Hal tersebut berakibat berkurangnya lahan pertanian di kawasan tertentu karena digunakan sebagai tempat tinggal dan perluasan pembangunan. Hal tersebut berdampak terhadap masyarakat petani, yang tidak boleh membeli lahan pertanian di kecamatan yang bersebelahan dengan domisili tempat tinggalnya, walaupun jarak antara lahan pertanian dan domisilinya masih memungkinkan untuk mengusahakan tanah tersebut secara aktif. Penelitian ini mengkaji dua (2) permasalahan pokok yakni, mengapa pada saat sekarang permohonan pendaftaran akta jual beli atas tanah pertanian yang domisili pembelinya bersebelahan kecamatan dengan letak tanah yang dimohon pada Kantor Pertanahan Kabupaten Sleman mengalami kesulitan dan bagaimanakah solusi terh adap kesulitan pelaksanaan pendaftaran akta jual beli tersebut. Penelitian ini merupakan penelitian hukum normatif yang didasarkan pada hasil penelitian kepustakaan dan didukung oleh hasil wawancara. Data sekunder yang digunakan dalam penelitian ini berupa peraturan perundang-undangan di bidang hukum pertanahan, buku-buku maupun hasil penelitian di bidang hukum pertanahan. Data primer diperoleh dari narasumber dan responden yang ada kaitannya dengan pendaftaran akta jual beli atas tanah pertanian yang letaknya bersebelahan kecamatan dengan domisili pemohon pada Kantor Pertanahan Kabupaten Sleman. Hasil penelitian dan pembahasan atas dua (2)permasalahan di atas adalah sebagai berikut: Pertama, pendaftaran akta jual beli atas tanah pertanian yang letaknya bersebelahan kecamatan dengan domisili pemohon pada saat sekarang sulit dilaksanakan di Kantor Pertanahan Kabupaten Sleman karena rekomendasi sebagai persyaratan pendaftaran akta jual beli atas tanah pertanian tersebut tidak dapat diberikan oleh pejabat yang berwenang karena masih menunggu adanya keputusan sidang panitia pertimbangan landreform Kabupaten Sleman, Kedua, solusi atas kesulitan pelaksanaan pendaftaran akta jual beli atas tanah pertanian tersebut adalah dengan adanya pertemuan antara pejabat dari Kantor Pertanahan Kabupaten Sleman dan PPAT se Kabupaten Sleman yang membahas sidang panita pertimbangan landreform Propinsi Daerah Istimewa Yogyakarta pada tahun anggaran 1999/2000 yang salah satu hasil kesimpulannya memperbolehkan peralihan hak atas tanah pertanian apabila domisili penerima peralihan hak berbatasan kecamatan dan letaknya masih memungkinkan untuk mengusahakan secara aktif.
The need of lands for people in Sleman District is increasing from time to time in line with the increased number of population. This leads to a condition that the farmlands are decreasing in certain areas because their function is changed into housings and other estate development extensions. Consequently, because of the decreased width of farmlands, farmers in Sleman District cannot purchase farmlands in the neighboring sub districts although the distance between the area the farmers live and the farmlands are still favorable to cultivate the lands actively. This study analyzed two main problems which were (1) why was the application for the registration of sale and purchase land certificate upon farmlands for people living in the neighboring sub districts with the land they want to purchase currently difficult? and (2) what were the solutions toward the difficult situation of registering the sale and purchase land certificate. This study was a legal normative study based on the findings of literature study supported by the results of interview. The secondary data were in form of laws, books, and results of studies concerning land affairs. The primary data were obtained from informants and respondents who were in relation with registering the sale and purchase land certificate upon farmlands that were located at the neighboring sub districts from where applicants lived in land registry office of Sleman District. The results of the study comprised two items concluding two main problems. First, the registration of sale and purchase land certificate upon farmlands which were located at the neighboring sub districts from where the applications lived is currently difficult to be implemented in land registry office of Sleman District because the recommendation as the registration requirements of sale and purchase land certificate upon farmlands could not be given by the officers of interest due to the fact that they had to wait for the legal decision of the landreform committee in Sleman District. Second, the solutions for the difficult situation were by holding meetings between officers of land registry office of Sleman District and all The Officers of Land Registry Office in Sleman District discussing the session of landreform in Yogyakarta Province in the period of 1999/2000 and one of the conclusions was the transferring of right upon farmlands if the applicants’ domicile was in the neighboring sub districts and the applicants could still cultivate the lands actively.
