2009 | Tesis | S2 Magister KenotariatanPeneletian ini dimaksudkan untuk mengetahui Pelaksanaan Pemberian kredit Pada PT Bank Danamon Cabang Palu, dan upaya Bank Danamon Palu dalam mengatasi hambatan-hambatan dalam pelaksanaan Pemberian Kredit. Penentuan lokasi didasarkan atas pertimbangan bahwa berdasarkan penelitian pendahuluan ditemukan bahwa pada PT Bank Danamon Palu dalam prakteknya ditemukan adanya penyaluran kredit yang belum memenuhi standar penyaluran kredit berdasarkan Undang-undang Nomor 10 Tahun 1998 tentang Perbankan. Tujuan penelitian ini adalah untuk mengetahui kesesuaian penyaluran kredit pada PT Bank Danamon Palu dengan standar penyaluran kredit berdasarkan Undangundang Nomor 10 Tahun 1998, dan untuk mengetahui faktor-faktor mendukung dan menghambat dalam pelaksanaan penyaluran kredit pada PT Bank Danamon Palu. Hasil penelitian menunjukkan bahwa pelaksanaan penyaluran kredit pada PT. Bank Danamon Cabang Palu telah sesuai dengan Undang-Undang Nomor 10 Tahun 1998, dimana dalam penyaluran kredit senantiasa memperhatikan syaratsyarat umum perkreditan dan prinsip kehati- hatian, seperti Prinsip 5 (lima) C, yaitu character (watak), capacity (kemampuan), capital (modal), collateral (jaminan), dan condition of economy (kondisi ekonomi). Dengan melakukan analisis secara seksama terhadap aspek pemasaran, teknis, manajemen, yuridis dan sosial ekonomi. dengan harapan akan memberikan informasi tentang itikad baik dan kemampuan membayar nasabah dalam melunasi pinjaman beserta bunganya. Faktor-faktor yang mendukung dan menghambat penyaluran kredit pada PT. Bank Danamon Cabang Palu adalah sebagai berikut : (1) Faktor pendukung : Dilakukan evaluasi dan kajian atas asset dan liability bank melalui Asset/Liability dan Risk Management Model (ALARMM). Secara rutin dan teratur dilakukan self assessment atas risiko operasional di setiap unit kerja PT. Bank Danamon Palu, dilakukan pula upaya peningkatan kualitas sumber daya manusia yang sejalan dengan perkembangan perbankan dan teknologi. Sedangkan faktor penghambat adalah : Masih adanya nasabah yang kurang memahami prosedur yang benar dalam pengambilan dan pembayaran kredit, sehingga menimbulkan kredit bermasalah. Kurangnya pengetahuan masyarakat tentang jenis produk dari Bank Danamon Cabang Palu.
This study intended to identify the implementation of credit grant of PT. Bank Danamon, the Branch of Palu, and efforts of Bank Danamon Palu to overcome inhibitors in implementing the Credit Grant. This study would be conducted in PT. Bank Danamon, the Branch of Palu. Location was determined based on consideration that previous study found that PT. Bank Danamon Palu, in practice, concerned with credit distribution, which did not meet standard credit distribution based on Law No. 10 of 1998 on Banking. These study objectives were to identify credit distribution consistency of PT. Bank Danamon Palu with standard credit distribution based on Law No. 10 of 1998, and identify supportive and inhibitive factors in implementing the distribution credit of PT. Bank Danamon Palu. The results of study indicated that the implementation of credit distribution of PT. Bank Danamon, the Branch of Palu, has been consistent with Law. No. 10 of 1998, where the credit distribution always considered ge neral requirements of credit and carefulness principle by analyzing aspects of marketing, technique, management, juridical, and social-economic properly, in hope that it gave information on customers’ good behavior and ability to repay for their loan and interest. Supportive and inhibitive factors of credit distribution of PT. Bank Danamon, the Branch of Palu, were as follows: (1) supportive factors: performance of evaluation and examination for bank asset and liability through Asset/Liability and Risk Management Model (ALARMM). Routine and regular self-assessment for operational risk of each work unit of PT. Bank Danamon Palu was conducted by identifying the risk, new risk issue was evaluated and action plan was performed to minimize/eliminate possibilities of risk. Efforts were made to increase quality human resources consistent with banking and technology developments. Whereas, inhibitive factors were: presences of customers less understanding true procedure in taking and paying for credit, so that it resulted in problematic credit. Less knowledge of society on types of products of PT. Bank Danamon, the Branch of Palu, than products of other banks.
