Kajian yuridis tentang pemberhentian kepala daerah pasca pemilihan langsung dalam mewujudkan prinsip demokrasi

Penelitian ini bertujuan untuk mengkaji pelaksanaan Mekanisme Pemberhentian Kepala Daerah sudah dilaksanakan sesuai dengan prinsip demokrasi dan aturan yang berlaku, kendala-kendala yang terdapat dalam pelaksanaan pemberhentian kepala daerah, serta upaya yang dilakukan untuk mengatasi kendala tersebut. Penelitian ini dilakukan dengan cara penelitian hukum normatif yang mendasarkan pada norma-norma yang berlaku yang terwujud dalam bentuk peraturan perundang-undangan, penelitian kepustakaan melalui studi dokumen terhadap bahan hukum yang berhubungan dengan obyek penelitian dengan uraian deskriptif, menggunakan data primer, sekunder dan tersier. Kemudian data dianalisis srcara kualitatif. Hasil penelitian ini menunjukan, pertama sistem pemberhentian kepala daerah masih menggunakan sistem perwakilan, kedua masih adanya aturan hukum yang memungkinkan politik mengintervensi sehingga dalam proses hukum setiap putusan hukum tidak mempunyai kekuatan, ketiga menghilangkan aturan hukum yang masih menggunakan sistem perwakilan dan aturan hukum yang memungkinkan politik dapat mengintervensi hukum

The purposes of the research are to analyze the implementation of The District Head Stoppage Mechanism that have done appropriate with the democracy principle and the set-up rules, the problems that exist on the implementation of the district head stoppage mechanism, also the efforts that taken to exceed the problems. This research done by the normative law research, which based on the set-up norms that realized on the legislation law form, library research pass through the document study concerning to the law materials, which have related to the object of the research with descriptive explanation, using the primary data, secondary and tertiary. Then the data analyzed qualitatively. The result of the research indicating; First, the system of the district head stoppage still use the delegation system. Second, there was still presence the rule of law that enables the political view to intervention the law and as the effect in law process on each decision, the law has no power anymore. Third, erasing the rule of law that still use the delegation system and the rule of law that enables the political view to intervention the law it self.
