Pertanggungjawaban P.T Alfa Goldland Realty terhadap konsumen perumahan dalam proses pensertifikatan tanah di Kabupaten Tangerang

2008 | Tesis | S2 Magister KenotariatanDi daerah perkotaan banyak orang berminat untuk membeli rumah dari perusahaan pengembang perumahan, namun dalam transaksi jual beli tanah oleh pengembang dibuat dengan surat Perjanjian Pengikatan Jual Beli (PPJB). Oleh karena itu pembeli yang telah melunasi harga jual beli belum terjadi peralihan Hak Atas Tanah sebab belum dibuat Akta Jual Beli (AJB) di hadapan PPAT sehingga belum bisa diproses pensertifikatan tanah. Berdasarkan latar belakang tersebut, dapatlah dikemukakan permasalahan : (1) Bagaimana pertanggungjawaban perusahaan pengembang P.T. Alfa Goldland Reality terhadap konsumen perumahan dalam proses pensertifikatan tanah di Kabupaten Tangerang dilihat dari, yakni segi yuridis; keuangan; dan administratif. (2) Faktor-faktor apa yang menghambat proses pensertifikatan tanah milik konsumen perumahan, dilihat dari sisi penjual; pembeli; dan Pejabat Kantor Pertanahan. Penulisan tesis ini dilaksanakan berdasarkan penelitian kepustakaan untuk memperoleh data sekunder dan penelitian empiris untuk memperoleh data primer, dengan menggunakan teknik pengumpulan data melalui studi dokumenter dan wawancara. Kemudian seluruh data yang diperoleh dianalisis dengan metode kualitatif dan kuantitatif dan ditulis dengan metode deskriptif. Hasil penelitian ini adalah : (1) Segi Yuridis, tanggung jawab pengembang adalah melaksanakan tugas dan kewajibannya, yaitu proses balik nama dan pensertifikatan tanah; Segi Keuangan, pengembang bertanggung jawab melaksanakan pensertifikatan tanah setelah pembeli melunasi seluruh harga jual beli; Segi Administratif, tanggung jawab pengembang adalah melengkapi dokumen yang berkaitan dengan tanah, seperti asli sertifikat, IMB dan lain- lain kemudian dibuat Akta Jual Beli (AJB) sampai pada proses balik nama sertifikat tanah. (2) Sisi Pengembang, hambatan proses pensertifikatan tanah tidak terjadi sepanjang pembeli membayar lunas harga jual beli dan pembeli telah mendirikan bangunan permanen di atas tanah kaveling, Sisi Pembeli, yang menghambat pensertifikatan tanah miliknya, karena pembelian tanah dimaksudkan untuk investasi kemudian bermaksud untuk dijual kembali kepada pihak ketiga dan belum mempunyai dana untuk mendirikan bangunan di atas tanah kaveling miliknya; Sisi Pejabat Kantor Pertanahan, hambatan tidak terjadi sepanjang seluruh dokumen yang berkaitan dengan tanah telah lengkap.
In urban regions, many people are interested in the purchase of the house from real estate developer, and the developer issues Perjanjian Pengikat Jual Beli (PPJB, Land-Sale-and-Purchase Contract). Transfer of the property right did not occur for the buyer who already paid for the sale price since Akta Jual Beli (Sale-and-Purchase Document) had not been yet made before PPAT (Land Certification Agency) so that land certification could not be processed further. Based on the background, some problems could be raised: (1) How is real estate developer of Alfa Goldland Reality Ltd. responsible to housing consumers in the process of land certification in Tangerang Regency, from juridical, financial, and administrative perspectives, (2) What are the factors that impede land certification process of the housing consumers, from the perspectives of seller, buyer, and the Official of Affairs Agrarian Bureau. This thesis writing was conducted based on library research to obtain secondary data and empirical research to obtain primary data, using data collection technique via documentary study and interview. Then the data obtained were analyzed with qualitative and quantitative method and they was written with descriptive method. Research results are: (1) From juridical perspective, the responsibility of real estate developer is to carry out is duty and obligation, i.e., trader the title of ownership and land certification; Financial perspective, real estate developer is responsible to process land certification after the buyer paid for sale price of the property; Administrative perspective, developer is responsible to complete the document related to land, such as original certificate, Building License and so on and then the developer has to process transaction certificate and transfers the title of ownership. (2) From the perspective of real estate developer, the obstacle of land certification process is not likely to occur as long as buyer had already paid sale price and built the house on the lot. Buyer perspective, the certification of his own land did not take place because land purchase is made for the purpose of investment and then he or she intends to sell it to the third party because he or she does not yet have money to build the house on the his own lot; the Official of Land Affairs Bureau perspective, there is no obstacle as long as the entire document related to land is completed.
